A New Sex Offender Takes Residence Under the Julia Tuttle -- Voluntarily

Wednesday, as lightning licked the skyline and a wall of thunderclouds bore down on Miami, New Times took a bicycle along the shoulder of the Julia Tuttle Causeway to meet Terry Brown, soon to be its newest resident.

Last March, New Times wrote about three sex offenders who had been placed by their probation officers beneath a bridge across the street from the county criminal courthouse. The location, we pointed out, was also across the street from a center for child victims of sexual assault. The State Department of Corrections duly responded by arresting one of the offenders for having been registered incorrectly (his address on the state database was that of his victim – a mistake that he insisted had been made by someone else) and by moving the other two offenders to another bridge – beneath the Julia Tuttle Causeway, where another two offenders were already living.

In Miami-Dade, offenders must not live within 2,500 feet of a school; a state law prohibits them from living within 1,000 feet of any place where children congregate. The Department of Corrections has made it clear that the men under the Julia Tuttle were put there because the causeway – surrounded by a mile of water in every direction -- is one of the only spots in the county they can find that doesn’t violate these laws. There are now eight sex offenders registered as living on the causeway.

Terry Brown intends to be the ninth. A clean-shaven, slightly paunchy, and well-dressed man in his early forties, Brown cut a unusual figure among the fishermen, homeless, and down-and-outers who trudge up and down the causeway all day. He is the head of a political lobbying group of his own creation called Hope4Tomorrow (Hopefortomorrow.org is already taken by a Christian missionary group), which describes itself as focusing “on strengthening laws such that they will be effective in reducing child sexual abuse cases in the U.S.” The wording is vague, and perhaps a little misleading – Hope4Tomorrow’s primary concern is changing restrictions on released sex offenders that Brown says are unconstitutional and, in fact, more dangerous for children because they push offenders into hiding.

Fresh from Kansas, today, Brown says, he too will register himself as living under the Julia Tuttle, in protest of local laws. Saturday, he says, his group and other “family members, human rights activists, child advocates, ex-offenders, and reporters from across the nation and the world” will gather at the Holocaust Memorial at 10:00 A.M. for a “media event” drawing attention to the injustice of current sex offender laws. Brown is himself a sex-offender, registered in Kansas with two offenses: aggravated indecent solicitation of a child, and sexual exploitation of children. He claims that one of the charges was without merit. “My own proposal would put me back in prison for the rest of my life,” he claims. “But it would be better than what we have now. . . let’s draw a line in the sand, that’s what I’m saying – rather than trample 600,000 people we need to identify the 20,000 who are dangerous and give them treatment.”

His “proposal” is a bit sprawling – he refers to a “five-pronged” approach – but in a nutshell, he thinks that offenders who committed less serious and one-time crimes should be placed in a different category than repeat offenders – like himself – who should be watched more closely. He also describes having been placed in a halfway house when he came out of prison, where he received shelter and treatment, and thinks the same should be done for the men under the bridge.

Brown had come Wednesday to “check out my new digs,” he said. He even had his mother along – she waved from inside his car. “I’ve already met some of the guys,” Brown said cheerfully. “One of them – Angel – is a very nice guy; his mom is back there, cooking him rice and beans right now.” Brown says he’ll stay for sixty days or until a change is made in the laws. When asked if he’s really prepared to live under the causeway with eight other homeless offenders for two months, he answers – “I don’t know-- I guess we’ll see!” The storm upon us, Brown offered a hand, got into his car, and vanished beneath the bridge. --Isaiah Thompson

With hope, this will bring out the disparity in the laws that do nothing to protect anyone, rather, by the contents of the laws, creates the homelessness as seen under this and most likely, many more bridges thru out this misguided nation. Yes, registration and segregation of groups never happened before in history did it Isaiah? I don't favor giving abusers a free ride, but seeing how this country is stomping on civil rights of a selected group without any due process under the 14th Amendment makes me sick. Legislators and media alike flatly ignore the testimony of experts on this issue. I would call attention to the report by the U.S. Department of Justice on the RAINN.org web site (RAINN.org is a victim advocate org.) This report from the DOJ says that 96% of child rape victims are assaulted by either family members, relatives, or someone they know and trust. NOT STRANGERS. WAKE UP AMERICA. A child is in much more danger in their own bedroom than they are from any stranger.

Good luck Terry, I hope your message reaches people. All of these new laws seem to be a national trend that is popular among politicians and ratings for the news media. However these laws have been based upon myths and ignorance than on science and research. They have been a reaction to fear and hysteria that resulted from child murders by those which should have never been released to the public. Now an entire class of people of near 700,000 Registered Sex Offenders are taking the brunt of it. According to the science and experts, only about ten percent or less are a threat to children and less than 1 percent fits the category of those that would fit the profile of someone that would murder a child. We as a society have every right to hate the Registered Sex Offender, but let me just remind you of what is written in our history books of the consequences that resulted in hating a class of people.
The typical Registered Sex Offender, which has been through the legal system, has been through punishment, has been through treatment and that lives in your neighborhood is less likely to be a threat to your children, than the over ninety percent of the undiscovered Sex Offender who you know and trust to be around your children. Child Sexual Abuse will always continue to plague our society until we become educated with the facts of what causes it. When we as a society become educated about the facts; only then will we be in a position to reduce or eliminate Child Sexual Abuse.

What Terry Brown and Tom Madison are doing this weekend at the bridge should never have to be done in our United States. When laws are made and passed that make its citizens live in a "sub-human" environment, we, as citizens, are on a fast road to hell in a handbasket. For someone who makes their living with news and information the author is rather "Uninformed". This is the most appropriate place as the Holocaust started with laws being passed to get Sex Offenders that were then ammended to include others.

Anyone who values their liberties and who has studied history should be afraid - very afraid - of these laws. Hitler, Himmler, Goebbels, all must be laughing and rolling in their graves seeing America enact and enforce the very laws they enacted some seventy years ago. Long before Hitler killed the first Jews in Nazi Germany, he paved the way for the wholesale disenfranchisement of human beings by — you guessed it — attacking the rights of sex offenders. From 1933 through 1936, a series of amendments were passed to Paragraphs 173 through 188 of the German Penal Law specifically targeting homosexuals and others determined to be “sexual deviants”.

The sex offender laws created under the Nazi Third Reich have been the model for “Megan’s Law” and many of the other Sex Offender laws being passed and enacted all over this once Great Nation. They established the first sex offender registry, required sex offenders to register their whereabouts and to wear pink triangles, carry special identification papers, and established draconian punishments for sex crimes that included longer prison terms, loss of voting and civil rights, civil confinement in concentration camps, and the death penalty. All of these laws were justified by the Nazi’s in the same way that our present-day politicians justify Megan’s Law: to protect the children from sexual predators. If this reason was good enough for Hilter to use then it is must be good enough for our leaders to support their actions with I guess.

Of course, as history shows us, the targeting sex offenders is just a way to establish the precedent of wholesale deprivation of human rights in preparation for attacks against all the people we want to deem as unworthy to live and/or work in our communities. Even now the existing statues are being modified and applied to other crimes, illegal aliens, and even the homeless to imprison and/or banish them.

It’s doubtful that the German people would have acquiesced to Hitler’s rounding up Jews, Gypsies, Communists, Socialists, trade unionists, and so forth, and sending them off to death camps in 1933 when he first ascended to power. Hitler had to first establish a precedent, like our present day Politian’s have, that some people are subhuman and unworthy of human rights — and they started with the most universally despised group they could find, Sex Offenders. And just as Hilter moved on to others using these laws, so have we. Martin Luther King, Jr. said it all;

Anyone who thinks that this couldn’t and isn't going to happen again is delusional. It has already started. Good Luck guys. If history is any indication of what is happening, and seems to be, as Gallowsman noted then you will be remembered for taking a stand here and now. Maybe if someone had taken a similar stand against the Nazi's and Hitler when he went after Sex Offenders the Holocaust might not have happened.

Thanks for all of the support out there! We will have success in bringing attention to this human rights atrocity much to the chagrin of the Miami Police Department who has tried in vein today to stop our media event at the Chamber of Commerce, 3rd Floor conference room at 10:00AM - any interested media staff should show up with credentials to obtain free admission.

Thank God someone is bringing this situation out into the open for the world to see how intelligently we deal with problems. Pushing them away and hiding from them is pathetic.

We live in a rich nation that takes pleasure in forcing people to live under bridges. We live in a Christian nation with none of the Christian attributes. People are thrown away. Nobody gets helped. Few things scare me but the attitude of our nation causes me a lot of fear.
I live among those who enjoy seeing people forced from their homes and under bridges. Intelligent people love the myths surrounding sex offenders and are totally unwilling to exchange them for the truth. There are more than 600,000 citizens labeled as sex offenders. If they acted the way you expect them to act we would not still be talking about Jessica Lunsford's murder to years ago or Megan Kanka's murder more than 10 years ago or Adam Walsh's murder more than a quarter of a century ago. Our focus would be on what has happened today and what else might happen before this day ends.
This is a job that someone needed to do but you can't teach people who think they already know everything. They can't handle the concept that all sex offenders are not child molesters. Thet don't want to know that half of child molestions involve another child it. It does not fit the inage.

The German people watched the Jews become segregated at the will of the government...so the media event at the Holocaust Memorial is not so inappropriate, Mr. Thompson.

The collateral damage inflicted on the children of those deemed sexual offenders is just a more insidious death than those children subjected to the Nazi showers.

And if that's not enough for you, review Joe McCarthy and his ability to incite Communism to a fever pitch throughout America. Kids watched their parents lose everything because of one person who found the spotlight for his "cause".

Americans are very susceptible to fear tactics based on hysteria...get yourself down to the bridge, Mr. Thompson and spend a night or two. I think you might have a change of heart.

I'm not sure what is "vague" or "misleading" about Terry Brown's website. Perhaps Mr. Thompson doesn't understand the plight of registered sex offenders who have served the sentences prescribed by the legal system. Perhaps he doesn't understand the facts and statistics published by both US Government agencies and numerous state studies.

But, what astounds me the most is that the ANY state, city, county, or country would enact laws that restrict ANY residents to living under a bridge! If, in fact, the following statement is true: "The Department of Corrections has made it clear that the men under the Julia Tuttle were put there because the causeway – surrounded by a mile of water in every direction -- is one of the only spots in the county they can find that doesn’t violate these laws."

In many cities across this great nation of ours, there are similar restrictions to that of Miami-Dade, in which "offenders must not live within 2,500 feet of a school." There are also restrictions in many other states similar to the Florida "state law [which] prohibits them from living within 1,000 feet of any place where children congregate." That type of ruling has been found to protect no one but serves to instill fear in the public. Perhaps we need to better determine from whom we actually need to be protected.

No harm done Isaiah. Sometimes consequences are unintended. I believe this is the situation with residential restrictions as well. What I can't understand is why Miami and DOC are allowing this to continue. Isn't it obvious there's a problem when we are wasting resources by checking up on offenders on a daily basis every night to make sure they are living in deplorable conditions while we allow them to walk around all day long when children are more at risk of coming into contact with them? Makes no sense to force them to roam around. We should focus on child safety instead of perpetual punishment of offenders. If we do not allow offenders and victims to heal and rehabilitate we will create more victims. NO MORE VICTIMS PEOPLE! Get these offenders a safe environment to live, work, do their probation and rehabilitate.

an estimated 100,000 men were arrested as homosexuals, and of these, some 50,000 officially were sentenced. Most of these men spent time in regular prisons, and an estimated 5,000 to 15,000 of the total sentenced were incarcerated in concentration camps.

To make my situation clear - I am accompanied this week in Miami by my mother who came along in support. I am returning on Sunday to Texas with her and will return later in the week to take up my 60 days residency under the bridge. I have committed to living there up to 60 days or until these men are provided suitable housing. Regardless of the high winds and lightning experienced this week or the rats and loud noise experienced by some of these men for over a year, I will follow through on this commitment. I spent five years in prison - 60 days in this Hell-hole will be a small price to pay to help bring attention to this severe human rights atrocity.

Mr. Brown is only one part of a group of people who are there in Miami to speak and bring you the true FACTS concerning recidivism and the stats concerning Sex Offenders. Our nation finds itself reacting to fear and applying tactics that are actually counterproductive to the better-good of society as a whole. We need to realize that 95 percent of molestations occur either within the family or from a circle of close friends or acquaintances. These are people who are usually not yet labeled as a sex offender. The registries have a tendency to give a false sense of security and actually divert the focus away from a much more likely source of abuse. From the point of view of the offender and his family, registration and residency restrictions are nothing short of a shaming mechanism that never allows the family to rise-above a human mistake. It can become a multitude of additional and never-ending punishment, not only for the offender but more importantly to his innocent children and spouse. Ok, our goal is to protect children, well, think about the unintended consequences imposed on all the children of sex offenders across this nation. Many times their lives are a state of complete confusion and turmoil as their family must move from one neighborhood to another. The extreme case here being the many-times still-loved father under a bridge. More usual than not, the sex offender parent is the main bread-winner in the family. When he can’t keep a decent job because his fellow employees or boss found him while searching the registry, how does this protect the emotional health and stability of the children in that family? After-all, nobody wants a sex offender working for them…do they? Then there’s the additional stigma the children of these families must endure when their friends and schoolmates find their father or mother on the registry. Imagine growing-up with these shame-producing, isolating, counter-productive life-struggles. Isn’t life difficult enough just trying to make it day-to-day? Does this help the offender and his family recovers from his trauma of a family member being incarceration and the shame and guilt associated with it? There are over 600,000 “registered” sex offenders in this nation. They are from every walk of society and every social structure; doctors, lawyers, judges, milkmen, factory workers. People make mistakes in the realm of their sexuality. The vast majority of those who have been caught and served their sentence simply want to get on with their lives. Many have done therapy and are truly sorry for their bad choices and want a chance at life again. Since the main bread-winner of the family is under the bridge, why not relocate his entire family, children and all under that bridge? This will undoubtedly protect children exponentially.

When (not if) the American people wake up to the real facts behind these vote getting scare tactics, there will be a large number of former law makers standing in line at the unemployment office.

What bothers me the most is, the fact we have such ill law makers in this country, and a law enforcement community which isn't much better. I think people who enact and enforce these types of laws need to have their head examined. I'm convinced there has to be some sort of mental deficiency. These laws are absolutely sickening, and have done nothing but destroy people's lives, and the ramifications of this are going to be felt for generations to come. This nation has sunk so low with the kinds of morals these people possess that make these laws. As far as using the Holocaust Memorial as a backdrop. I think it's more than appropriate. This government is turning into a Nazi-like regime that oppresses, segregates, and destroys countless lives. I do not use the word Nazi lightly, I would directly compare the politicians in this nation to Nazis, and would call one a Nazi to his face. These politicians have no morals, or traits which I consider to be human, but of demonic, sub-human origin which are not associated with our creator. At some point, they will pay the price of eternal flames for the misery they've inflicted on mankind.

My question is where are the experts that know the current policies are counterproductive and actually doing more harm than good. Where are the psychologists and experts who have done their homework, participated in the comprehensive studies and work with offenders on a daily basis? How can they in all their knowledge and understanding stay on the sidelines while the politicians continue to exploit this area of their expertise. I call on all of the experts out there who have the empirical data in their hands to finally show one-tenth of the courage that Terry has exhibited by moving under a bridge and risking his life to finally stand beside this man in solidarity for what you know to be right.

Terry may have made some mistakes in his past, as most of us have, but he has paid a huge price for his bad choices and now is branded for the rest of his life with a label society considers the absolute scourge of the earth.

How many of you out there have not made a bad choice in the realm of your sexuality at some point in your life? How would you like to be featured and burned forever into the halls of infamy, exposed to the world on the internet with your address, picture and complete identity for the rest of your lives for those mistakes which you so desperately attempt to hide from everyone even in your immediate circle of influence?

As far as the politicians and ultra-conservative news pundits out there go. When you guys get up there on your legalistic and self-righteous soapbox and preach tougher, more inappropriate laws, additional registry requirements, residency restrictions and punishment for sex offenders without first becoming informed as to the true statistics, dynamics and psychology behind the problem, I ask you if you’d be willing to prove your own purity in a very simple way. Lets see how many of you are willing to be part of a live television show where you are placed before a panel of ex-sex offenders and their families who have struggled through, incarceration, losing everything, world-wide exposure on the internet, lost-jobs, lost-housing and suffer continued, ongoing shaming and vigilante abuse. If you are truly without sin, I ask you to have the courage to be hooked-up to a high-tech, sophisticated polygraph lie detector device. You would be subjected to intense questioning in regards to every aspect of your possible past sexual improprieties, fantasies or bad choices in the realm of your sexuality by this panel of sex offenders and their families. If you come-out clean then you have the right to be considered all-holy, perfect and righteous. But I’m afraid there is one human nature trait that has proven itself time and again. Those who make the most noise usually have the most to hide. How many politicians and ultra-conservative news pundits out there would agree to this proof of their innocence and self-righteousness?

In America, where "sex sells" and "hysteria sells." We have become even more intrigued by "sex hysteria sells." I am so encouraged by the comments to this article -- even more than the article itself.

In keeping up with national politics and national media, I see so many issues that don't even know where or how to jump in and have a voice or make a statement. I applaud Terry and these other civil rights activists for making a much-needed stand.

I am not a sex offender. I am not a media mogul. I am not a politician. I am not a victim. I am John-Q-Public. And I am tired of billions of dollars of taxpayer dollars being spent towards legislation that continues to do the exact opposite of helping America safeguard our safety and 'our children.'

Bills after bills are proposed and passed by legislators that need to 'look tough' on crime by lawmakers while the public stands by and applauds, accepting the myths. Experts after experts share the facts about the low recidivism rates of former sex offenders, the benefits of treatment, the consequences of making stable residency/employment/treatment opportunities readily available, the misguided 'safety' that laws project, and the collateral damage to the victims and family members of the offenders.

There are so many disparities in how we perceive the problems and solutions. Some will talk about the rich and/or politicians getting away with crime (such as the kiddie porn on Mark Lunsford's computer, the recent alleged charges against Joshua Lunsford, the ongoing silence about Mark Foley's investigation, the surprising results of Barry Kutun's charges). Some will talk about the thousands of teenagers listed on the sex offender registries (some are even in the single-digit ages). Some will talk about the fear of a sex offender living in their back yard, without ever knowing their neighbor's true story or realizing how more risky the drunk or thief in the block may be.

Why do I care? Because in my many years in recovery, I've met so many grateful recovering sex addicts doing their sincere recovery work towards being healthy and productive members of society, while the laws around them continue to mount ongoing obstacles to their success. So much emphasis is being placed on retribution instead of therapy or other proven proactive methods. This whole problem, frankly, begins with education -- of both parents and children. What are we coming to when parents think that the Internet registries will keep their kids safe? Over 96% of the NEXT offense will happen by someone that is NOT on any registry. Yet we continue to impede the progress of the 600,000+ offenders from appropriate re-entry and recovery in society, based upon the 3 or 4 high-profile cases that are egregious.

As an ordinary taxpayer, I demand that the media and legislators show facts instead of myths and listen to the countless experts. Again, I applaud Terry and the others at this press conference to shed light on how we must move forward to use our time, talents, money, and resources more appropriately in this situation.

I have attempted, cajoled, begged, persuaded, screamed at the traditional press to take up the story of Florida's sex offender laws...what it takes to be made an offender (not much-in many cases, physical contact has not occurred), the federal law enforcement funding connected to the sex offender registry that is reduced should a state not comply with federal regulations, the F.S. Statute 943.0436 that does not allow judicial discretion in offender cases, F.S. Statute 800.04 that carries the same sentencing weight for solicitation for lewd and lascivious as if the act had actually occurred (many offenders on the registry are registered for such) and the use of the sting operations by law enforcement to "protect our kids"....many have been ensnared and convicted as offenders merely for typing words on a keyboard...is the use of the sting operation even legal in these cases? (The use of the sting against John DeLorean was thrown out as he was not a person predisposed to commit a crime...many persons caught up in sting operations fit the same mode).

Don't get me started on the power of probation in this state...more power than the bench...that is for sure.

Let's look from the victim's point of view. Every time an offender is viewed on the registry, the victim is revictimized because in many cases, the offense in familial.

Don't get me started on Mark Lunsford-his work has succeeded only in hiding the truly dangerous behind the faces of those that politicians want the public to believe are predatory..all because the State did not supervise the likes of Mr. Couey properly.

The laws have succeeded in the ruination of people, careers, families...I challenge New Times to dig behind the image Tallahassee paints with the Fear brush and inform the public about what is really going on.

Those unfortunates living under the bridge are a living example that these registries do not breed "safety for your kids". They breed isolation and devastation to ANYONE who has the most minor of offenses regarding even the mere appearance of a crime. Normal teenage activity could land your child in the same circumstances which led these guys to be homeless, jobless, and without any hope for regaining a decent life.

Thanks to all of you who have organized and participated in this event. I wish I could be there in person, but my thoughts and prayers are with you.

I never thought I would be supportive of such a thing, but when it hit close to home for me, I was forced to realize that the witch hunt for sex offenders in this nation is an outrage.

A relative of mine is facing a ten year prison sentence for having a one-time consentual encounter with an underaged girl. That's it. Not a predator, not a pedophile, not violent, first arrest of any kind, father of two small kids, normal decent guy who wouldn't harm anyone intentionally. Sound like someone in YOUR house?

SHE was the relentless aggressor; he was physically, emotionally, mentally, spiritually and financially broken.

HE takes complete and sole responsibility for his actions, even though he was quite probably not ABLE to maintain his adult boundaries anyway given his mental state.

Still, he has been removed from his family, his children, his community and is going to be locked away for several years. And years from now, when he gets out, he begins his LIFE SENTENCE.

Registry, tracking, public scorn, no opportunity to regain employment, housing, privacy or safety, no quality of life, no protection from vigilantism for himself or his children... if he's even allowed to resume life with his children.

Why? Because of our current laws, and the continuing public pressure for harsher sentences and restrictions. The people on this bandwagon are misinformed and have a one-sided agenda that is destroying THOUSANDS of families all over America.

These laws need to change. They need to distinguish between a one-time lapse of judgement, and someone who is actually a danger to society and your children.

PLEASE wake up and realize that "sex offender" means a LOT of different things... and the laws and restrictions currently in place do not take that into account.

And residency restrictions??? HA! Hats off to Florida and every other state that bought into that brand of legislation in order to "protect our children." Nice job.

Now you've got registered sex offenders who are already scorned, condemned, rejected, labeled, hated and tracked... out in the open without even the basic human necessities. I'll be honest, enough of that treatment and I'd be tempted to break the law again just to get a mattress and three squares a day.

One people have paid their debt for their crime, that's it. They should be allowed to reunify with their families and merge back into society to become responsible and self-sufficient citizens again.

I know all of you have been anxiously awaiting news on the outcome of the event in Miami that we have all been working so hard on.

A late change in plans was put in place to hold the press conference at the Miami Chamber of Commerce located directly across the street from the Holocaust Memorial.

Terry Brown paid for the membership to the chamber and the conference room was secured. On the application we told the Chamber we were a human rights organization and that we were holding a press conference.

Yesterday, I spent about three hours on the phone with Miami police Captain James Hyde, who did everything in his power to try and head us off at the pass. He initially told me there was a Federal ruling which was just handed down barring us from holding the event at the Chamber. This later turned out to be false. He flat out told me we should have a "plan C" which left me with the impression that he and other Miami officials were going to force the Chamber to renig on our use of the room, which they ultimately did . Terry is in posession of a letter which clearly demonstrates that this is in fact what occured.

It is my belief that Miami City officials strong armed the chamber of commerce (which is privately owned) to bar us from holding the press conference inside of their facility. I will be writing a detailed article and account on this later this evening.

When the group arrived at the Chamber this morning the area was inundated with police. The police stopped everyone in the area grilling them on what their business there was. They threatened the individuals in our group that if they stepped one foot on the Holocaust Memorial or touched any part of the memorial, they would immediately be arrested.

Journalists and onlookers alike were sent away. Tom did manage to hook up with a journalist from the Miami Herald and he and our members regrouped under the Julia Tuttle causeway. They had their speech and recorded everything.

The ACLU is involved but I have no further details on that at this time.
