Nevin Shapiro and His Attorney Threatened New Times With World's Silliest Lawsuit

Nevin Shapiro and his Coral Gables attorney, Maria Elena Perez, have the national media eating out of their hands these days. Shapiro is trying to bring down UM's football program, and Perez -- who's not in jail -- has helped him by making TV appearances. But the pair wasn't all that happy last December when New Times published its own investigation of Shapiro's Ponzi scheme and sordid South Beach life.

As the world argues about Shapiro's credibility, it's worth considering that he sent us one of the most absurd lawsuit threats we've ever received. It argues that the convicted Ponzi schemer was actually a "successful businessman," that we cast Miami in a "negative light," and that we were just not very nice to a guy busted for stealing millions of bucks.

Perez never returned multiple phone calls or emails from New Times while we reported our story on Shapiro, but the day after it ran, she sent our attorney Steve Suskin her gem of a complaint.

Here's the second half of the run-on sentence she uses to open the letter:
"In my opinion, New Times is not a newspaper or even a leaflet, as it offers nothing which is noteworthy, newsworthy or reliable, and it similarly serves to cast Miami, the city which generates income for New Times, in a negative light when it refers to South Florida as a Ponzi capital and when it describes the 'black depths of Biscayne Bay.'"
Uh, OK. The combination of Bernie Madoff, Scott Rothstein, Allen Stanford, and Shapiro doesn't equal Ponzi Capital USA? And Biscayne Bay is kinda deep!

Perez goes on to argue that Shapiro didn't bilk investors of $880 million (the size of the Ponzi he pleaded guilty to constructing in September 2010), but in fact "lost" only $79 million. And it was his Ponzi victims' fault in the first place!

"An estimated $56 million went to pay the usurious loans which were being made by some of the alleged victims who... were driven by greed," she writes.

In fact, Perez writes, Shapiro was a nice, successful grocery diverter until a "series of unfortunate events" forced him to "be creative with his business."

We're sure the judge loved that reasoning when he sentenced Shapiro to 20 years of hard time for his financial "creativity."

It goes without saying: We stood by our story, and we still do.

nevin pled guilty and cooperated, and STILL GOT HAMMERED with 20 years.  a defendant who pleads guilty and cooperates, and doesnt hire maria elena marcia perez gonzalez juanita soto gets a reduced sentence.  seems the gables door law lawyer knows as much about defamation as she does about criminal defense.

This is an outrageous allegation against Mr. Shapiro.  The same hack con man, Bobby Thomson, who stole over $100 million from the Navy in 01' in Tampa is living in the neighborhood of Nevin's offices as one Bear Smirinoff.  The Feds act as if their hands are tied while Arab oil attorneys go after honest Jewish businessmen to cover the tracks of a systematic impoverishment of our nation by the same characters that brought down the towers.  When false accusations fly and jealousy reigns, the truth is only mumbled.

you are a clown and if you have any doubt about the allegations being lodged then I invite you to take a trip to Indianapolis and look over the documentation that is in the hands of the NCAA.  I am certain it will make you a true believer.  It is also very shallo thinking to critique the lawyer who is just a messanger of truth that is too hard for Miami fans to swallow.  Bottom line is that they just should not have engaged Mr. Shapriro in the manner that they did.

Shapiro broke the law for starters and violated NCAA rules by being a booster and offering student athletes improper benefits. Benefits that Jesus himslef may have had a hard time turning down. This is not a unique situation as there are Nevin Shapiros all over college sports at every level. To further the point, if Nevin "loved Miami" then how is he going to do something that he knows would have an ill affect on the University as well as an impact on the student athletes should this ever come to light. He was malicious in his actions towards the University which he loved so much. To me that is all a bunch of garbage which is my opinion. I am writing to discredit you as a lawyer or defending Nevin, which is what you're supposed to do if retained. I simply do not buy his position towards UM. I also have a very difficult time beleiving that this trangresssion went on for 10 years. That is 10 years with out anyone ever saying a word to anyone else that was in contact with Nevin about what he was doing. I find that difficult due to numerous Universities being flagged by the NCAA for less and in a far less time frame. Ohio State was flagged after 2 years or so. Michigan, LSU, Georgia Tech, North Carolina, USC just to name a few did not partake in any illegal NCAA activity for 10 years. That is a hard pill to swallow. Yes there are pictures with Nevin and former players. When were the pictures taken? Who knows. Did he buy a lot of things for the players on the team, it's possible that he could have. Can he prove it other than saying he did? I don't know that he can. Whether he has a heart of gold or gold spray paint, the day he approached the first student athlete from UM and offered improper benefits his love went right out the window. He was in it for himself for future gain. Again, no attack on you. Just my opinion.

The only evidence is hear say. Shapiro talks about doing this and that but has no real hard evidence. How does a credit card bill statement showing an expense tie a player to it? I might as well give you a receipt from Best Buy and say all that was for Pryor.
