Florida Court Rules Pasting Kids' Faces on Naked Adult Bodies is Not Child Porn

Danny Parker, a Sunday school teacher from Lakeland, Florida, was arrested and eventually convicted on child porn charges in 2009 after he was found to have cut out the faces of children from photos he'd taken and then pasted them on the bodies of explicit photos of adults. Now, a Florida appeals court has overturned the conviction and says that under Florida law he was not technically in possession of child porn.

Parker, 41, had volunteered at the Lakeland Acres Baptist Church and at a youth camp at Lake Wales Care Center. He took pictures of young girls at the church and camp and then went home and cut out their faces and placed them on pornographic images.

He was sentenced to five years, but according to The Lakeland Ledger, his conviction has now been overturned by the Second District Court of Appeal.

The court ruled that while Parker's behavior was reprehensible, his actions don't add up to trafficking in child porn.

"The crudely constructed depictions, fortunately, leave no doubt that no child engaged in the sexual conduct," reads the court's opinion. "Accordingly, we cannot conclude that Mr. Parker possessed child pornography. The legislature's words constrain us."

Parker will now likely walk free. He said he was inspired by news that a Lakeland-area elementary school principal was arrested for similar actions. He too was convicted on child porn charges, but that conviction was overturned in December.

They should have at least put the man in a psychiatric environment-court ordered treatment-but technically "images of children engaged in sexual activity" is pornography-even if the images are drawn in pencil.  How many really believe these guys can flirt with temptation and entertain their dangerous anti-social and aberrant thoughts/fantasies without acting out their obsessions?

Well, he does have a pedo-face. All joking aside, I think people need to stop overreacting and mind their own god-damn business. If they're not touching the kids, let them have their fantasies. If you have a problem with it, arrest the people who film the porn, not the fans. People should be allowed to express their paraphilias within their own homes.

So many of u think this is ok, i can see how...but what if it was a picture of your child? Its one thing to think about it but he took the next step to make it more realistic by using photos. To set him free is saying 'we think its wrong but we wont stop u'. Its only the beginning for creeps like him. What if he then decides to procede with his sick fantasies and tries to harm a child? Pretending the kid is an adult or going for the taller kids because they look more adultish. Its sick what he's doing. I can understand having to let him go and i can understand how some if u r ok with this but he has to be stopped.

So, what about other pictures, stories, media, etc? 

Five years? And what, when he got out? Somehow do you feel he will be "all better" and not in an even worse situation (and, though I have no evidence to cite) where he then commits an offense so much worse than this?!

I think it's legitimate to be be concerned, of course; the man works (worked?) around children, in a position where he might be given a lot of trust. I can only hope he will at least come out of this with some sort of counseling arranged.

Oh i agree about the counceling part and i hope they never let him near children again! However my issue isnt that i think 5 years wouldve done better...its that so many ppl r ok with this having happened. Its scary to think he got off this easy. Yes i think he deserves punishment but the sad truth is that our 'justice system' has no justice. Hes free-nothing i can do personally but morally i feel others shouldnt condone his behaviour. Hes sick mentally if hes gone to the point past only thinking but he still knew better. At this point animals like that should be deserted in the deepest pit on earth to rot. Let him think there. Just venting but i c ur point of view.
