Police Officer Peter Munoz Arrested for Killing Woman While Driving Drunk

Peter William Munoz, a 24-year-old member of the Coral Springs Police Department, has been arrested and charged with DUI manslaughter after hitting another car in Coral Gables over the summer. The other driver, Jennifer Gutierrez, 23, died of her injuries.

The incident occurred just after 4 a.m. on Saturday, July 16th. Munoz was off-duty at the time, and driving in his own vehicle. Munoz was treated for minor injuries at Jackson Memorial after the crash, but he walked away with relatively minor injuries. The same can't be said for Gutierrez who died four days latter due to her injuries.

A toxicology report showed that Munoz's blood alcohol level was over the legal limit.

Munoz turned himself in to Coral Gables police today. He's being held at Miami-Dade's Pretrial Detention Center on charges of DUI manslaughter and vehicular manslaughter. His bond has been set at $22,500.

Harsh words from her aunt, Damaris about driving drunk. This from someone whose own husband was found guilty of DUI. Citation #132323W incident date 6/25/99 (miami dade clerk of courts).  Intresting as well that her cousin, Rickyricardo was recently arrested 1/26/12 (miami dade clerk of courts) for possession. If her toxicology did come back with irregularities like the other poster said. (Luis Rodriquez) where might she have gotten these drugs.They only want the law when it benefits their side. These facts and public reccords.

Seriously dude all of you are insane!! Her family goes on and on about it's his fault for being drunk and driving too fast- HELLOOOOOOOOOOO SHE RAN A STOP SIGN!! If pepe from the corner was going 40 the usual speed limit in the gables she would have still gotten hit cause what?? Cause she ran a stop sign!!!!!!!!! I am so sorry for the girl I have lost a friend to a true drunk driver- where the drunk driver was actually at fault!! It was a straight road and the drunk swerved right into my friend which rammed him into a tree- he died on the scene and also had to be cut out of the car!! My friend didn't violate any traffic laws he was driving straight unfortunately she did!! I am related to 5 officers which includes my father and guess what?? They are normal people JUST like me and you.. They make mistakes- THEIR HUMAN!! Should Peter have been speeding? No!! Should he have drank and driven? No!! But if Jenny didn't run a stop sign she'd be with us!! It's not the other way around people!! She should know if she was sober driving at 4 am ESPECIALLY in Miami is dangerous and therefor should have been driving with caution!! The Fact That He is a cop and got behind the wheel drunk as hell is ALL that matters. Period, If He wasnt DRUNK nor SPEEDING Then Jenny Wouldnt Have Been Needed to get Cut out of her car... She was hit Soooo Hard That The Doctor Announced Her Brain Dead Come On People... She was Hit Sooooooo Hard on 35mph .. WTH ?? Seriously People Make Mistakes But They Pay For it .. And he Needs To Pay For it Regardless. If He Would of been going 35 or 40 she wouldnt have been killed, she would of sustained minor injuries just like how the cop did. If only those on this comment board were the ones who were doing something illegal and something happened to them, would they be singing the same tune? You continue to push the bill on him which is fine, its your opinion. The truth of the matter is here, there are two people at fault. One was drunk and speeding. The other out entirely to late for being a pregnant mother, but lets throw that out of the equation, how bout the suspended license? There are reasons why the state of Florida suspends your license, one being that you are an un trust worthy driver. There is a reason why Jennifer had a suspended license.   She should have never been on the road that night. Now, now, Peter should be let off the hook. He messed up badly. Hes probably done this many times before and like many of us, me included, have drank and drove and thankfully nothing happened. In this case something did. He plowed his car, which was speeding, into a car that rolled through a stop sign. Whether he was going 40 or 80 her car should have never been in that intersection. Now if you are family to this poor girl i send my condolences, may God rest her soul. But this ma'am was an accident. Drive by's are murder, a man upset at his wife for leaving him and killing her thats murder, 9/11 thats murder. This was a mistake. A horrible mistake but a mistake. This man will face his punishment but what you want is for crucifiction. That's not right.

If we take the DUI out of the scenario the girl was at fault, she had no license it was suspended for over 20 tickets in three years. This is not a normal driving record, and she ran her stop also. So there were many factors to this accident, and both drivers contributed to this devastating accident. A driver with a suspended license runs a stop and dies, when another driver hits her in an accident and now we find he was under the influence of alcohol. I feel both are at fault. This man will be on trial soon and his fait will be decided by a jury of his peers, where all the actual facts will be revealed. For those of you who think he will be put in jail for the rest of his live. read the law if he is found guilty the max he will get is 5years that is what the law states.

This is utterly ridiculous. To say that peter intentionally meant to do this is so incredibly stupid. People make mistakes.. and granted it was a big one, but he is in no way, shape or form, a murder. Murder is intentional and this was no way intentional. I am sure we all have made decisions that we will regret... and this is a big one that Peter also regrets. I do not doubt that he is terribly sorry and sends his condolences to the family. I know Peter as a person and this was just a mistake.. could have been you or me or anyone else. We all make mistakes. Do not call the kid a murder. You are all speaking out of anger and not being rational.

Peter is a nice guy and Im sure Jennifer was a great girl. May she rest in peace. God calls all his children at some point and unfortunately she was called under these circumstances.....I'm sure Peters family never intended for their son, who just graduated from the police academy in February , to lose everything in the blink of an eye. As I'm sure Jennifer's family never saw her future ending with a car accident, but this is life everyone. Peter is not a bad person....if he did not have compassion towards people he would not have become a cop. In all reality it has nothing to do with him being a police officer as he was off duty. I am a nurse and as a nurse we promote well being and health but I know plenty of nurses that smoke cigarettes.....he was not born a police officer just as I was not born a nurse....its not who we are its a job just like any other job only is magnified in situations like this to better way out the other persons opinion.... Jennifer's family I'm sorry for you loss and you are mourning right now but even if peter was over the limit the traffic reports states she was at fault in the accident. PERIOD. and that is the key term ladies and gentlemen ACCIDENT. Please look it up...because I am certain peter did not drive all night waiting for Jennifer to illegally take a stop sign for him to hit her. Please put yourselves in Peters shoes....ppl drive over limit all the time...and that doesn't technically mean drunk...over limit is more that 2 beers. How would you feel if you drover " over limit" from only drinking 2 beers and someone illegally crossed and you hit them ? and by Gods hand that person died.......Peter has to live with this....He is 24 years old just graduated and everything he has worked for is gone.......and he is now in jail with his thoughts....ans as you all know we our sometimes our worst enemies and critics....as a person that serves and protects i am 150 % that he is feeling the worlds most ultimate guilt. I pray that God bring peace to his mind and heart. I don't understand why the cop is givin a chance to trial when most of the times a drunk driver is automatically convicted after a vehicular man slaughter, for this gentle man that was a police officer should have known the laws at the moment he stepped out of his home to have drink or two no matter how much he decided to drink he should have called a cab even as humans we all make mistakes but his was poorly made do to the fact he works or worked as an officer one whom enforces and protects the rights of each and every one of us so buddie I understand he's your friend family what he is he was irresponsible and now he must be tried stronger than a normal citizen this argument is inexcusable he didn't die he killed someone after taking the wheel drunk so stop the ignorance and face the fact he is responsible for her death I don't wish no bad upon no one but he he fucked up easy as that kid........

It is amazing to me to read some of the coments posted on this article..... "Murder"?? No it is manslaughter; while murder is premeditated, maslaugher is accidental.....The Coral Springs Police Depatment had nothing to do with the accident, the officer was off duty. Unlike the Miami News Times who just like to create headlines, I did some research  on the person that unfortunatelly died in the accident. She had 20 moving violations between 2004 and 2011, three of them in June of 2011 including one for driving Knowingly with a suspended licence, a criminal charge, another for operating a hazardous vehicle, and a speeding. In may she had another speeding. At the time of the accident her license was suspended, and she again was KNOWINGLY driving breaking the law. She also ran a stop sign which caused the accident. I am sure that all of you would not be so quick to claim culpability if you were the ones driving and got involved in the accident, with this person, which by the way, had a habit (as illustrated by her driving record) of being a careless driver. Ran a stop sign plus a suspended licence is guilty on my book.

i get that she didnt have the best driving record. But if that "officer" wasnt going so fast and wasnt completey trashed, shed probably have a chance at life.=( its not fair to either family, but i do honestly belive that an officer of the law should be heald responsible weather on or off duty. any one caught at that hour driving drunk would be arrested officer or not. justice will prevail. its in GODS hands now.

he was DRUNK. .229 thats almost 3 times the limit.  this is not even referring the fact that hes a cop.  

DRIVING with a .229 alc level and going 85+ mph along with hitting a car with a person and killing the person  = prison  

nothing to do with him being a cop.  

now the only factor left is to compare similar cases in which the same has happened.  i dont think you need to have that much of an imagination.  but if this were to happen tomorrow to somebody else.  who would you want to take to prison?

That sceneraio sir is an assuption of your part. Your cousing had a suspended licence, had received a vilation in JUne for driving KNOWINLY with a suspended licence, and was again braking the law. She was not authorized to be operating a motor vehiclae at the time of the accident, and she also ran a torp sing. Those sir are facts....not assumptions.

But that is not what happend and yes we need to look at her driving record because she was driving, not walking. Im sorry for your families loss, but Peter needs to be held accountable for his mistake, but your cousin was also wreckless, she ran her stop this accident would not have happend.

rickyricardo, im sorry your family member passed away, but the report is there. She was at fault for the accident. and she had a terrible driving record. peter had no such thing. he had one accident a few years prior due to wet roads. and THAT IS IT. He is a credible and honorable person. They are both at fault. Her: for taking the stop and driving without a license & Him: for getting behind the wheel after drinking. He did not kill her. This was an accident.

The postings on this site are insane, I understand the girl’s family members wanting to blame someone. They are in mourning, going through all the pain of losing a loved one, anger and blame is a normal and understandable reaction. But all you others just throwing things out there with no knowledge is just irresponsible. Fact::: the young single mother of a 4 yr old, ran through her stop at 4am on a Saturday, this same driver was driving knowing that her license was suspended, due to multiple traffic violations in the past 3 years when I say multiple it was over 17 tickets for moving violations, in 3 years. Her blood test may have come back tentatively, for alcohol but they were pending for drugs due to prev ticket. The male driver had the right of way and yes it was found he was under the influence in my opinion totally irresponsible. In response to why his test took so long to come back, 1st two blood test done locally where found to be inconclusive, so they were sent out for further testing, I emphasize inconclusive. Why he was not arrested at the scene, because he was also injured and taken to the Trauma center where he remained a few days, and again blood test inconclusive you can’t arrest with an inconclusive result. His previous accident was driving on a wet road not due to driving under the influence, no prev tickets on his DL. There has been no cover up due to him being an officer; it’s ridiculous and ignorant how people always go to that. To those of you wondering why he was in the Gables, Peter worked for Coral Springs but his family lived near the scene. Many things will be revealed in court, we will have to wait and see. But I can tell you if I was ever picked for jury in a case similar to this, I would need many questions answered, especially why test kept being inconclusive then 2 months later positive. It can be said that the officers are not covering, but railroading. This cover theory can go both ways.

 It is ridiculous that you are saying all these things, you are right people do need to get the facts straight including yourself. 10 mph ma'am please, physics will tell you that she can stop at that speed if you see a car coming. Your niece was def going faster and the officer was stopped at the stop sign that was blocked by a huge bush. But you would only know that if you saw the seen of the accident. No one is saying that your niece will not be missed, nor is anyone saying that it was ok that it happened to her. But do not accuse that other man for something that was an accident. This accident occurred at 4 am ma'am, if your niece was pregnant it already shows bad judgment and how irresponsible she was to be out at that time. Although the police officer is said to have had a blood alcohol level that was above the legal limit, show me what your nieces level was that night, because for someone to be out at that time, I can assure you they were up to no good. Like the saying goes "nothing good happens after 12". Since she is your niece, I'm also sure you are aware of her driving history and well other issues she had so dont make it seem like there's absolutely no way she may be at fault her. If the tables were turned and the officer were killed, she probably would qualified for vehicular manslaughter as well. Unfortunately, because he is a police officer ppl think they need to judge them much harsher. Understandable that you are upset but don't lie, the situation is bad enough and this person will now live knowing he took someone's life. What you should be doing is using the death of your niece as an example to prevent this from happening again and get the city to bring down that bush; instead you are using your anger to ruin another's life as well.
