City Commissioner Michelle Spence-Jones is looking for vindication at the expense of the city's top law enforcement official. According to a Feb. 14 letter her civil attorney sent Katherine Fernandez Rundle, Spence-Jones is preparing to sue the Miami-Dade State Attorney's Office for allegedly violating her civil rights were when she was being prosecuted in two separate public corruption cases.

To show she's not playing, Spence-Jones retained a New York City law firm that represents one of three former Duke University lacrosse players who were wrongfully accused of raping a stripper in 2006 and who are now suing cops in Durham, N.C.

Reached Monday afternoon, Spence-Jones declined comment. A spokesman for Rundle did not immediately respond to a request for comment.

Last year, Spence-Jones was acquitted at trial on charges that she had solicited a $25,000 bribe from prominent developer Armando Codina.

Five months later, state prosecutors dropped separate grand theft charges against Spence-Jones after the case fell apart. In both cases, prosecutor Richard Scruggs' star witnesses, Codina, and Spence-Jones former mentor, former commissioner Barbara Carey-Shuler, retracted testimony that implicated Spence-Jones. Codina and Carey-Shuler also accused Scruggs of misleading them into believing the elected official from Liberty City had committed a crime.

Spence-Jones was twice suspended from office and spent close to two years fighting the state attorney's office. In her letter to Rundle, Spence-Jones claims she "sustained damages as a result of prosecutorial and investigatory misconduct, compelled self-incrimination, unlawful and unreasonable arrests."

The commissioner also alleges the state attorney's office repeatedly defamed her and her criminal defense lawyer, Peter Raben. She specifically notes the close-out memo in the grand theft case in which Scruggs alleges Spence-Jones and Raben planted the documents that helped exonerate her in a box with other records from the investigation. 

In the Duke lacrosse players case, charges were dropped against the young men after revelations that the prosecutor, Mike Nifong, had lied, made public statements that were prejudicial against the defendants, and engaging in conduct involving dishonesty. Nifong was disbarred and criminally charged with lying to a judge. He served a one-day sentence for his fraud on the court.

Spence-Jones should concentrate on showing up at City Hall more than 3 days a month. The taxpayers are forced to pay her $106,000 per year plus her chauffeur and her fat pension. She should try to actually show up?

All anyone has to do is to read these comments to know that Michelle has a case.  She has been defamed by a prosecutor who was politically motivated and her reputation was irreparably damaged.  No proof and yet people accuse her of all kinds of things.  She has children and this should not go unpunished especially since the prosecutor should not ever be pursing a political agenda.

I’m sure it took a lot of nerve for someone to sue the State Attorney, But we must let a jury decide if Rundles office bent the rules, and showed favor, from the looks of it, she did, why? Because how can you indict only one person for bribery? It takes one or more to commit such a crime. Mr. Cordina and Glas was not charged because there was no bribery.

You seem obsessed with  this case! It  seems like you are trying to stand up for MSJ, but you are making matters worse by attacking anybody who disagrees with you. If people want to be calling names etc. you should not go down to their level. I don't know if MSJ should have been indicted or not, and neither do you. MSJ was found not guilty in one case, and the other case was dropped. She should put it behind her and move on. Maybe she did not do anything that was legally wrong, but it is not ethical to ask a developer for a donation before a vote on issues related to him. Neither is it ethical to accept grants for her family to purchase only 49 % of a building. It was not managed well. The place was never an art gallery. It was a sad little cafe without a real kitchen in one part and a  small  salon in the other part.  You must never have been there. Unemployed people should have gotten the grant. People who would work hard and spend time and energy to make this business work should have been given this opportunity. This project did end up costing a lot of money. People's lifes were affected by it , but it did not seem like MSJ did care...And BTW people should not be shouting "racism", and that goes both ways.

Your statement constitutes libel unless she has been convicted. After the entire weight of the State Attorney's office and vindictive members of the city commission tried for years to convict her all they had was false testimony from one witness who recanted and testified she was told to perjure herself in court. Unless you have proof act with some class and hold your tongue, it's very unbecoming to slander someone else because your feelings are hurt. What are you, twelve again?
