Miami Beach Cop Punches Handcuffed Spring Breaker In the Face (Video) UPDATE

The Miami Beach Police Department's brass probably winces anytime they hear the words "You Tube" these days. After this past year -- when their cops were caught on tape killing a Memorial Day Weekend visitor and speeding recklessly around South Beach -- amateur video is a recipe for MBPD heartburn.

The latest video, though, isn't quite so clear-cut. It does show a Beach cop punching a handcuffed Spring Breaker in the face. But it also shows police dangerously surrounded by heckling, drunken visitors. Judge for yourself:



The video was shot on March 17 on South Beach, according to the video's uploader.

CBS4 talked to MBPD's chief, Ray Martinez, about the video. He tells the station that the man in blue shorts threw something at officers as they patrolled the rowdy Spring Break crowd.

When the man allegedly tried to resist after being handcuffed, he was hit with a "distraction blow" -- a punch/open-handed strike combo police are taught to use in such situations, Martinez tells the station.

Miami Beach City Manager Jorge Gonzalez also tells CBS4 that the video doesn't seem to show cops breaking any rules.

"It appears this use of force was within our policies practices and procedures," he says.

"You need to look at it in context and the person is not exactly cooperating with the police department and there seems to be a crowd that is forming around the officers, so they need to take the actions they need to take to ensure the safety of everybody including themselves."

Update: The suspect in the video has been identified as Oscar Galvis, a 26-year-old Miami resident. Galvis works at Miami New Times as a production designer. According to a police report, Galvis yelled "Fuck the police, let's get 'em" before resisting arrest. He's facing charges of battery on a law enforcement officer and resisting arrest with violence and disorderly conduct. Galvis declined to talk about the incident; he's pleaded not guilty.

He wasn't hit hard enough but I know that while in jail he will be discipline...and the low class crowd surrounding the cops shouting and instigating should have been pepper sprayed several times and send back to their trailers/section 8 housing to cause havoc in their miserable life.

What exactly needed to be subdued? We should stop making excuses for officers that show poor professionalism and judgment, disrespect for citizens, and an unhealthy and inappropriate attitude regarding their position in society.

Due to social media many police officers are getting misrepresented.  Yes, I agree there are some officers that abuse power but there are also many working hard and putting their life on the line to protect us from people just like on this.  Perhaps, the next time that you are in the mood to exploit an officer that is just doing his/her job, think about if it was you, your children or family that was in danger, I am sure there would be no complaining then...  There will come a day when we may need help, however, due to ease, desire and entertainment in plastering things on social media, when called, our officers will take their time to show up, perhaps shrug their shoulders, or simply turn away; because at the end of the day they too have a family and need a job and have no desire to be all over the news in a negative way when we should in fact be thanking them.

I'm sure you've heard the phrase "avoid even the appearance of impropriety?" Police officers need to understand that despite what they would like to happen, their actions may well be recorded and posted online for anyone to take out of context. Perhaps instead of designing departmental policies around "distraction blows," they develop some departmental standards which won't look like police brutality on youtube.

This isn't police brutality by any stretch. That guy needed to be subdued and the crowd subdued. He wasn't a victim of anything other than his own stupidity. Justified and legitimate use of force in my opinion.

 Subduing someone is one thing, assaulting a person is another, especially a person who is defenseless. Sorry man you're openmindedness is out of place in this scenario. You restrain and bring the guy down to the ground and keep him there, cuff him, stand him up and if he's still acting out have a cop on each arm to take him off of the beach. I would even understand pepper spraying him in the face to make him cooperate. But no cop has the right to punch a person, defenseless or not. If I punched you and you (defenseless or not) would be assault. Police are not above the law. No one is.

The rule of law, at least in spirit, implies that all are subject to the same set of rules. Hernandez5749 is right when he says that if he punched someone it would be assault. I doubt that he could claim it was a "distraction blow" and have anyone in the police dept. take him seriously.

While the average non-cop might feel that, were he or she in the same situation, they would have done the same thing, let me point this out: we surrender certain rights and freedoms to the state in exchange for certain things. Part of the exchange is that we hold the state and its agents to a high standard of accountability. At least in theory.

The guy was being a dick and resisting arrest, to top it off you have a volatile situation with the crowd which I am sure was more than a majority of drunks.  As a fact of law, maybe the punch is a step too far but I don't see fault with the officers actions.  he did not continue to beat on him, it was reactionary to a person who was obviously resisting arrest.

Cops should have pepper sprayed all those idiots that wouldn't back away.   One guy is even touching the dude on the ground as the cops are trying to restrain them.   I think the cops showed extreme patience in this case.
