Lawsuit: 7-Year-Old Charter School Student Was Molested by Classmate, Tried to Commit Suicide While School Did Nothing

The Downtown Miami Charter School is being sued by a mother of a 7-year-old boy who claims her son was repeatedly harassed and sexually assaulted by an older schoolmate. The mother claims that harassment and molestation got so bad the boy attempted to commit suicide, while the school did nothing to intervene.

According to the Associated Press, the younger boy, only identified as "John," told his mother that in November 2011 an 11-year-old boy forced him to perform oral sex in the back of a school bus.

"If you don't do this, I'm gonna hurt you," the older boy said according to police reports.

The mother claims she informed Rebecca Dinda, principal of the Downtown Miami Charter School, about the incident. Dinda assured her that the boy would be separated, closely monitored, and that the incident would not happen again.

But the suit claims that the harassment continued, and that the boy was molested a second time in a school bathroom.

The boy became so distraught that his mother claims he tried to commit suicide twice: once by standing out in traffic with his eyes closed, and another time by sticking a metal hanger in an electrical socket. He is now undergoing therapy and on psychiatric medications.

"John" has since left the school, and the mother's attorney says that they will be seeking millions in damages. Neither Downtown Miami Charter, nor its parent company, Fort Lauderdale-based Charter Schools USA INC., have not commented on the case.

My daughter also goes to the school, This will be her 5th year attending Downtown Miami Charter School. I haven't had any problems or concern about the teacher, parents, nor the students. Hopefully justice will be served.

 One can only ultimately only wonder how the 7 year old boy was subjected to such abuse not once but twice and why the 11 year old boy wasn’t immediately brought forward. Then again assuaging and controlling the behavior of a young boy’s intent on hurting others (when they perhaps seek to recriminate the hurt they feel themselves) can only ever be a thankless task. Wow! I used to go to that school and that would be the last thing I expected. That's just sad.

my child  goes to that school.  i have volunteered in that school and did made a complaint one time and they did nothing..  when parents come to pick up their kids half of the time they don't even know where the kids are in the school.  they need to make the school a better system

Sounds like the mom pulled a McQueary: instead of calling the cops, she contacted a school administrator.

what if this was your child?? this is a disturbing situation because my child goes there and i have many bad experiences with the staff and front office desk office administrators.. i even mad one complaint to them and they did nothing about it.  unprofessional.  but there are so many to blame the mom the principal the teachers and the guidance counselor of the school.  but this incident had to have happened
