Karlie Tomica To Be Charged with DUI Manslaughter

It's official: Karlie Tomica will be charged with DUI manslaughter for the hit-and-run death of Shore Club executive chef Stefano Riccioletti. The self-described South Beach "Party Princess" will be in court today where she'll officially be hit with the charges.

After driving home in the early hours of the morning after working all night as an underaged bartender at Nikki Beach, police say Tomica crashed her car into Riccioletti. As he lay dying on the pavement out front of the Shelborne, Tomica allegedly took off. A good Samaritan followed her to her Mid-Beach apartment building and alerted police.

Originally Tomica was only charged with leaving the scene of a fatal accident. However, police say test results came back earlier this week showing her blood alcohol level three times the legal limit which paved the ways for the harsher charges. According to the Miami Herald, in addition to the manslaughter and leaving-the-scene charges Tomica will also be hit with DUI property damage and resisting arrest without violence.

A DUI manslaughter conviction in tandem with a leaving-the-scene conviction carries a maximum sentence of 30 years. A DUI manslaughter charge on its own would have only carried a maximum sentence of 15 years.

Yes Oscar Diaz. I am telling you I have never gotten drunk and driven a car. Maybe that's because I don't drink. Or the few occasions I have drank. I have someone sober drive me home. The elephant in the room that nobody is talking about is the overwhelming prevalence of underage drinking on South Beach, all of the "high end" clubs allow local, underage socialites into their clubs to get drunk, they turn a blind eye to obvious fake ID's. The old men around here won't argue against it because they're depraved sex fiends , the parents are vapid materialistic whores themselves straight off the set of "real housewives of wherever" and the clubs love having model looking 18 year olds in their business either working or partying...

At least Miami New Times has come to its senses and to professional reporting and its not longer calling her names or mocking her tweeter name. Its only the trashy piece of crap Miami Herald go STILL is calling her names and mocking her. After all is said and done, as human beings that we are, one can not help it but to feel a huge void and a huge sadness for her and for Chef and his family. May God bless Chef and his family. So far the story makes sense, but whenever I read 'resisting arrest without violence', it shows the corrupt hand of police... you can charge anyone under that charge.  Pretty girls have it easy in Miami Beach untill they do something crazy like this. Other minorities like gays and blacks can't even look at MIami Beach Police. If you are single male or a couple of males at night at the beach, MBPD will attack you for no reason, while these drunk girls can do whatever they want...

She is still being charged with fleeing the scene. On top of that she will receive a DUI manslaughter charge. So no, This doesn't send the message of 'if you flee you have nothing to lose.'

" Living the scene of an accident causing death" on top of DUI manslaughter, on top of, on top of....(fake driver license, et all) It unfortunately looks very gloomy for Karlie. Although I condemn her actions I can help but to feel sorry for her. And for Chefs family as well.

@mexkompa1 @drakemallard That and video evidence showed that the pedestrian darted in front of Stallworth's car and was illegally crossing that street. Stallworth paid a million dollars as I recall to the family of the victim. The video evidence from the writeup story showed that even a sober motorist, that the pedestrian was going to still get hit just the same. Stallworth stopped though, didn't keep driving on.

The do the rest of the math on recognizing that there are several reaction stages to stopping a car. It's not as simple as saying they printed a manual that says you must be in total control. Reality is, if a pedestrian is hell bent on crossing the street in front of a car going 40-50 mph, time & physics are reality. ZMaybe that driver's manual is a force field and can protect all from harm. The sooner pedestrians, cyclists and motorists start living in the real world and not some downloadable pdf or paperback version of reality, the sooner people can take the necessary actions to live to be with their families. I do it, everyone else seems to do it. There has to be a moment that when you look both ways that even the dumbest animals realize racing a car to cross the street is a stupid wager when you lose that race. 2 things my Dad taught me as a child and as a driver, you don't race a train as a motorist to cross the RR tracks. The other as a pedestrian or cyclist, you don't race a car after looking both ways. The safest thing you can do with any doubt in your mind, stay on the sidewalk and let the car pass. Sorry I irritate you, but people like yourself irritate me equally because you argue with a paperback manual, not the real world situation that anyone was handed at that moment in time. You do realize that there are crazy people too, those with a death wish trying to commit suicide too.

@Jimbo99 Although I feel for Karlie is for people like you that I get enraged. Stop defending what is not possible to defend. Have you ever read your motorist manual? Have you ever heard of defensive driving? When you are driving YOU ARE SUPPOSED TO BE IN ABSOLUTE CONTROL OF YOUR VEHICLE. You are supposed, (since you are in control of the equivalent of a tank), to be in the look out for pedestrians, bikers, situations, ANYTHING. Its your responsibility to be alert, cautious, to monitor your rear view, side mirrors, to see who is on your side, on your back and all over in front of you miles ahead. To foresee situations, to prevent them. To check your tires, your car. EVEN IF pedestrians jail walk, even if bikers are on your line, STILL you are responsible. So what, are we supposed to run over pedestrians, bikers only because they made a mistake? Don't be fool.

In regards to Dante S, only reason he got away with it is because he is famous and got money and the family did not want to persecute. END OF THE DAY. 

If he had time to flash the lights, to knock the horn...you mean to tell me he could not slammed the freaking damn breaks?? are you serious or just delusional? A Bentley is a high performance car. It can stop in a heart beat. It can be maneuver. Dante excuse is so full of shit and crap it just make me so mad! So you meant to tell me, he saw him at the distance and he flashed the lights and horned but since the guy didn't run fast enough or move fast enough, well, he just damn run him over. what a full load of crap. He could had easily turn left, right, go against the wall. TRUE is the party asshole was drunk his ass after a night in Liv, was jamming his radio, probably on the phone and never really saw the man until the last minute. END OF THE DAY.

End of the day there, we don't know what arguments were made by prosecutor or defense ? Just like this tragedy, who knows if the chef was crossing the street where there was no crosswalk, whether he saw the motorist and was trying to beat her to the other side of the street. Speculation, the news/media isn't reporting all of the story and we don't have video to our viewing satisfaction to determine and make those judgements. I went by what I read in other stories that in the Reyes/Stallworth that the video showed a pedestrian hell bent on crossing a street and there really being an arguable window of time for someone/anyone to stop. When someone flashes lights and honks a horn, it's probably easier to assume the pedestrian can stop a lot quicker than a car at 50 mph. Even change their path to avoid being hit. But jut to give you an idea 50 mph is 73.33 feet per second. So you tell me how close they were to each other and how much time & distance to stop a Bentley 50-0 ? According to this close to a football field ?
