Man Hit With 115 Police Rounds in Memorial Day Firefight Never Shot at Cops, Report Shows

Raymond Herisse was killed on Memorial Day two years ago in a hail of police gunfire.
Ever since police unloaded 115 rounds into a car driven by 22-year-old Palm Beach man Raymond Herisse on Memorial Day weekend two years ago -- a firefight that wounded five bystanders and was caught on video -- a key question has been, What triggered that onslaught of firepower? Police waited days to announce they'd found a gun in Herisse's car, but did he start the barrage by firing at cops?

A newly released lab report strongly suggests Herisse never pulled the trigger. He tested negative for gunpowder residue on his hands, a key forensic clue in shooting cases, the Miami Herald reports.

Herisse's family's lawyer, Marwan Porter, slammed police over the report, telling the Herald: "Any notion that Raymond fired a gun out of his vehicle, which may have allegedly given justification to unleash 100 rounds in his vehicle, is unfounded."

It's never been clear exactly what sparked the barrage from police that killed Herisse and wounded five others on the scene. The repeated blasts of police fire played on loop on CNN for days after the shooting:



The newly released report is public because Herisse's family and the innocent bystanders hit by police fire sued the department and accused them of dragging their feet on their investigation; a judge ordered some of the records from that investigation released last week.

The lab report contradicts then-Chief Carlos Noriega's story: After police found a Baretta 92-F in the backseat, he said, "We were told he discharged his firearm. Now we need to confirm that with ballistics."

But it likely won't change the department's justification for killing Herisse (who was later named a suspect in a Boynton Beach robbery). They say he tried to run down officers with his car, and using a vehicle as a weapon is considered sufficient provocation for police to fire in most cases.

Whether or not he fired, police union chief Sgt. Alex Bello tells the Herald, doesn't change the case. "Regardless of whether or not he had gunshot residue on his hands, the guy was clearly a threat in an automobile that can take out a bunch of people," Bello says.

Hey y'all, you're MISSING something folks: the initial gun fire, PRIOR to the suspect's vehicle stopping in the intersection, was almost ALL Semi-Auto fire.....ie, HANDGUNS..


When the 'firing exercise' began POST intersection stop, THAT fire sounded very much like AUTOMATIC GUNFIRE.....RIFLE FIRE, ie, M16's on SELECT FIRE....3 rounds PER SECOND..


One M16 on full auto has a cyclic rate of around 550-600 rounds (bullets if you like) PER MINUTE.

Do the math people, that's 10 rounds PER SECOND.


Let's do the math again, shall we?

There were a LOT of cops out there, looked to be around 5 or so, who could well have been armed with M16's........all of them firing, using 30 round magazines in the wells of their rifles.

5x10=50 rounds (again, bullets if you like) PER SECOND being fired, IF all 5 were firing on FULL AUTO (ie, in Machine Gun Mode), again assuming they were using M16's, that should have been a total of a hair under 350 rounds that SHOULD have been in the vehicle, were they on full auto.


I watched the video a number of times and by my count the main firing POST STOP lasted about 6.7 seconds.......so.......since there were 'only' 122 rounds in the vehicle, we're back to Select Fire, which is used to CONTROL the rate of fire and is a SAFETY PRECAUTION (trying to NOT hit any 'good guys').

5x3=15 rounds PER SECOND, so rounding up to 7 seconds gives us:

15x7=105 rounds in those 6.7 seconds....add in the PRE-STOP rounds from the police and viola.....you've got your 122 rounds.

I'm as interested in the HOW as I am in the WHY, because without the HOW, I don't believe we'll ever get to WHY.

I was a few blocks from the shooting that night. Unbelieveable that the cops are so reckless with their power. We trust these individuals to protect and to serve our citizens, not blow 115 rounds into a car that didn't even start the shooting. The car was surrounded at the moment the shooting started. His gun was never found until days after. I was there the day after while the detectives were survying the area. They could of easily discovered the gun in the daylight the day after. The car didn't move from that spot the entire day of the investigation. Also, if you look up Memorial Day Shooting Miami Beach on Youtube, you will see another angle of the shooting. The bystanders video taping the shooting on their phones where approached by police with guns drawn. There is no reason that the cops should have had their guns drawn on these people. THE SUSPECT WAS ALREADY DEAD! After that they attempted to take the evidence from the witnesses. Also worth mentioning that the cops did have another altercation that evening that resulted in another shooting.

Let's assume he was a criminal. 115 rounds? All over the country it's the same thing, the police are out of control and above the law. The answer is that the people must regain control of the police by any means necessary which in my opinion will require armed self-defense by the citizens. The powers that be are determined to maintain control through terror and they must be resisted at all costs or it's slavery.

F..k That Guy......I was There and this guy was running over people like it was a PS3 game................a Lot of people got hurt because of that guy........Before that shooting you saw on the video, he was on Collins Ave. and 14th St and had just run over 2 Miami Beach Bike Patrols and 3 more young ladies had broken ankles, bruises.....not to mention the stampede of people stomping on others running from this guy..............Now if one of those was your sister your girlfriend or your mom.........You wont be accusing the man of the Miami Beach Police Department of abuse of power or call them a gang.........They Stop a man that was Threatening all of us and our families........Peace

I have never EVER seen an M16 in LEs hands on Miami beach, even during MD weekend. I saw a restaurant on lock down with a 3 block perimeter after armed men fled a gas station robbery and there were no ARs. Guns were were drawn but no rifles.

8 officers unloading a 15 round magazine = 120. If they were all +1 in the chamber you're at 128. There's your vehicle and your bystanders.
