MEDA Responds to New Times Article on Wynwood Crackdown: "Compliance With the Law Is Not Optional"

On Tuesday, New Times reported the backstory behind the recent police and code enforcement crackdown in Wynwood, which has led bar owners to suspect that Operation Dry Hour is more about downtown clubs stifling competition than about safety. When we looked into the allegations, we found that downtown clubs do, in fact, have a close and lucrative relationship with police. The clubs have complained to both cops and local politicians about "unfair competition" from Wynwood bars. And police have admitted these complaints spurred them to action in the up-and-coming neighborhood.

But one downtown club owner accuses New Times of fomenting conspiracy theories. "This reporter likes half-truths as much as half-baked ideas," says Michael Slyder, owner of Mekka and president of the Miami Entertainment District Association. Click through for his full response to the piece.

Slyder does make some good points, such as that Wynwood bar owners' ignorance of the law is no excuse and that lax regulation puts the public at risk. But both of those points are spelled out repeatedly in the article.

He also makes some personal attacks, calling me a "hack, gonzo-want-be-journalist." (You're only half-right, Michael. My daily mescaline intake alone qualifies me as a full-bore gonzo quack.)

Slyder also asks if New Times readers are "so stupid as to believe this crap." I trust they are smart enough to read the article and decide for themselves what is going on in Wynwood.

Here is Slyder's full email to New Times:
Ignorance isn't bliss - it's just damn ignorance. It appears that the owners cited in the article freely admit that they have violated the law and don't seem to draw the connection between law enforcement and their actions, opting instead to frolic in the grassy knoll of conspiracy theory. As I said to the hack, gonzo-want-be-journalist Mr. Michael Miller, the bars in the Entertainment District have and continue to be closely regulated by the police and that this has been the case since late 2007. We have been cited, arrested, and shut down into code compliance. There are many lines that we do not cross and we accept the limitations imposed on us. We rarely apply for special event permits because we know that the City will expect strict compliance with fire and safety codes. Downtown clubs don't have outside music and have expended hundreds of thousands of dollars to lessen our sound footprint in the district, including the costly enclosure of an open terrace. Don't think for a second that the police and fire department have moved on from our district. Mr. Miller was also told about a MEDA member that was recently shut down for serving past 5am; another member had fire code complications that seriously impacted his plans for this year's Winter Music Conference. This reporter likes half-truths as much as half-baked ideas. Honesty seems a rare commodity for some of the Wynwood business owners who would like you to believe that they have insubordinate employees who serve just a few minutes past 3am, that they're neighbors don't complain about noise disturbance, and that the fire department and code enforcement have cited them for minor infractions. Are the New Times readers so stupid as to believe this crap? Public safety and compliance with the law is not optional. You can't grow a business by violating the law and in doing so, create an unfair advantage against your supposed "Park West competitors". Yes, you heard me correctly - an UNFAIR advantage. Given the expenses in Park West, do you think that these clubs can compete with small bars with no cover and two-for-one drink specials? The Miami Entertainment District Association (MEDA) is more than just policing; it is an organization that allows us to work together for the common good of not only our businesses but our community - a bit syrupy and cliché but nonetheless the truth. We have provided back-packs and Christmas toys to thousands of local children, sponsored gun buy-back programs, and have contributed to a number of other community causes. Why don't you write about that Mr. Miller? But if it is the hiring of police that interests you, then it should be noted that violent crime in the Entertainment District has decreased approximately 15 percent since the policing program began in 2010. Our security receive regular training from the police and are taught that they are protectors - not overzealous enforcers. We call for service without hesitation before an incident escalates into a serious problem where people can get hurt. MEDA officers work under the direction of the Commander and recognize that the management of a nightlife economy is most effective when it is done in cooperation with the businesses. Cooperation is not synonymous with collusion; I know it's not sexy or salacious but it is nonetheless the truth...the full truth...and the only truth. Conspiracy theory implies an "Unlawful plan formulated in secret by two or more persons". It appears by Mr. Miller's own admission that several of the Wynwood bars have conspired to secretly complain to the Miami New Times about a rogue business group that is resolute on shutting bars down that knowingly violate the law. Are we left to believe that the Miami New Times is nothing but a propaganda machine deployed by some clandestine, shadowy group in Wynwood to shift public opinion so that the police will step back and allow these bars to continue serving liquor well into the morning hours? I have no facts to support such ridiculous claims and the fact that no one really cares about what the New Times has to say inoculates me from such silly, irrational paranoia. One final point: let's imagine for a moment an ugly, horrific event that occurs sometime in Miami's future. Allow me to provide the New Times title of the article: "Miami Bar Owners Found Guilty of Faulty Wiring in Killer Fire - Police and Fire Departments under Suspicion". The downtown Miami district started around the turn of the century with South Beach not granting new liquor licenses and some residents not wanting after hours spots on The Beach any more. To make it appealing for investors and owners, Miami offered the sweetheart deal of a 24- hour liquor license.  

South Beach's vibe changed forever.  And, IMO, not for the better.  DWNTWN never had the sense of community old SoBe had in the days of Liquid and Groove Jet.  Wynwood, however, does.  


That said, Slyder and MEDA can call it what they want.  Conspiracy theories, realized conspiracies, or just good old politics.  All the same to me.   DWNTWN is threatened and using enforcers to stymie the new guys.

First of all is anyone looking at the big picture and asking the most logical Question here....WHY IS DOWNTOWN ALLOWED A 24 HOUR LICENSE in the first place.  Its a menace to our society, promotes and encourages methed out, coked out people of all ages to stay up for days,   Is this good for anyone? Is it a good look for the city?    Ive never experienced more cracked out people, wanting to fight, unders drinking, trannys hooking and pickpocketing as I have in MEKKA.  Why do clubs like this need to be open.  Its not a good look for Miami.  It makes space look like a church. The city needs to  pick more responsible club owners who know how to run their clubs cleanily safely and provide good entertainment not   amatures from BUFFAlo ny whose only experience is a small gay bar .  The City officials should be more selective in  who owns a 24 hour licenses.  Or they should all close at 5am,  Do you think anyone would go to MEkka if it wasnt the  only choice.   This concerned complaining Mike Slyder leader of MEDA is not concerned with upholding laws( obviously if you have been to MEKKA) he is only concerned about his own business and snuffing out the upcoming wynwood area.   MEDA can try to be politically correct and collect guns, or give toys to tots but we know this is just the charity card being played, its old and simply does not mask what goes on down at the 24 hour crack clubs. Seriously MEDA is even a lie...crimes still happen they just dont go over the 911 call center they go to the hired cops and et never get reported.  Crime appears lower and MEDA looks like a success. Also, why would the city let this happen?? Here is why: the city wants to hire more cops in order to reduce crime rates. There is a surplus in the city budget but how it should be spent/saved is under fierce debate.

Some on the council (I've read) don't want the money to be spent on extra cops. If the "city" sits by and lets the cops have their way, then perhaps the Wynwood owners will cave in and hire the extra off duty cops. Recall that MEDA tried to meet with them for this purpose after the bully tactic. How do we know that MEDA didn't try to sell this to the commissioner in such fashion. Hardly a conspiracy theory as you might suggest, Mr. Mekka. Makes good sense: have the Wynwood owners pay for the extra policing, let the city pad its crime stats and spend the surplus money elsewhere. This is all after these people spent previous years money on a baseball stadium no one wants and virtually bankrupted this place. These are all my opinions.

Amazing. As a local attorney/club regular with 12 years ties to the area it looks as follows. I've read the article and response. New Times is not out of line in any way with this article. Here is why: -True, Wynwood venues were not in compliance and fire code issues/code compliance had to be handled at some point. Miami shouldn't be a banana republic forever where some things shouldn't be enforced. -Much worse however is corruption, which is what made this place a banana republic in the first place. That MEDA gives so much in contributions to police for "off duty work" raises the appearance that police are very friendly with Downtown venues (which are still a much grimier/nastier location than Wynwood, and also, not as cool musically/filled with weirdos like Mekka, and my opinion is shared by many. -Thus, in order to dispel the appearance of impropriety, the police/city (should actually be looked at as ONE entity, despite what Sarnoff says),would of course go out of its way to invite club owners to the meeting about enforcing ordinance violations. That didn't happen.That the cops "forgot" to invite the owners is a major, major red flag here to me as an observer. The totality of the circumstances gives us the appearance of impropriety. Ignorance of the law is no defense for club owners, but these people are contributors to the community who make the area great, and calling them to the meeting was a minimum standard. Police use their DISCRETION to enforce law, whether speeding, ect. Community standards to apply .The cops had a responsibility - but not an outright duty - to tell the club owners about the stepped up enforcement - and they did not do so, and then went on an attack style operation not far from what they do in the ghetto (in my years as a local PD I saw this). -Would you fight a ticket for being pulled over two miles over the speed limit? I think so. Community standards to apply. It would be as if the cops suddenly started ticketing everyone for 1mph speeding violations. There would be outrage. Further, the corruption scandal re: code enforcement in South Beach makes local owners lose faith in the abilty of govt to even have fair/legal code compliance. -Most clubbers would prefer to go out in Wynwood, period, so the downtown clubs might be sick of this and no one wants to lose business. Hypothetically of course: Space may have never seen Pickle as a threat in the past, but that type of thing may have changed with the popularity of "underground" music. Everyone wants it now. -This looks like a classic example of government bullying. I would encourage the owners of Wynwood to band together, and find a a way to defend themselves in court in the future when bullied like this. They are easy to take down one by one but won't be as a group. Wynwood, band together and build political influence. Its time. The clubbers/families/adults I know don't want to go hang out by Overtown, and this bullying won't change that.

the clubs and bars in downtown (except for The Corner) are DUMPS! It's well know there is tons of underage kids, underage alcohol, and drug abuse. THE ONLY people I see going into MEKKA are club kids, underagers, and drug users/dealers. Or i guess people who have no taste. I would bring my coolest cousin, GF, or Mom anywhere in Wynwood before I bought any of them to any of those dumps from Mekka to Space. TRASH, BRO

1. The New Times has a bigger following than your useless MEDA does .... we're talking 30,000 vs. 100

2. You're the PRESIDENT of MEDA as well as the CFO of MEKKA .... maybe some people who follow you (let's say the old geezers of the community) haven't graced your establishment with their presence, but I'm POSITIVE if and when they do, your small following of 100 will quickly dwindle down to half or less. It's pretty much a drug infested dance hall which opens Saturday nights and stays open until Sunday afternoon....'nuff said


3. Wynwood / Midtown is WORLDS apart from the "Entertainment District" ....this isn't a conspiracy theory that New Times is trying to implant, they're just delivering the local news out of the mouths of its locals.
 

Wynwood / Midtown is the type of district you can go and enjoy with friends and with your family. I think the type of ambiance and POSITIVE impact that it has brought to our city SHOULD get praise and a cushion :) sure law is the law....but having under covers sit at their bars until the moment the clock strikes 3:10....is SO VIOLATING....followed by arresting everyone? really? what happened to THEIR warning?

The reason the Entertainment District is still alive is because of the money the city makes off of it. So YES when the organization is backed up by the same off duty cops who patrol the Entertainment District (which it seems all they're there for is to make sure come daylight there hasn't been a shoot out or an overdose in any of the establishments) it DOES seem a little fishy.

No matter what you try and argue facts are facts.... Wynwood Miami is bringing back the CULTURE to the city and it's impacting other small districts such as Little Haiti and Little Havana to do the same. That's what makes a city flourish in a POSITIVE way and that is what will make other people want to move to Miami or visit, NOT the nightclub strip that your establishment belongs to.

All their bars/clubs suck and are far more dangerous than the Wynnwood ones. Downtown spots just aren't fun. You got all these wound up bros trying to scrap every minute harassing every girl they can as axe body spray is dripping from their armani exchange shirts onto their Abercrombie pants. All the liquor sold gets taxed anyways so if I'm spending my money to be out till 6-7am I want to do it somewhere I feel like I won't have to deal with idiots. If the law wasn't optional then why didn't they enforce it heavily before. All of a sudden you have cops doing sting operations on bars, why not use that man power on better things like the massive crime that plagues Miami or hell catch that asshole that almost killed me while driving and talking on his cell phone.
