Miami-Dade Police Choke Black Teenager Because He Was Giving Them "Dehumanizing Stares"

Fourteen-year-old Tremaine McMillian didn't threaten police. He didn't attack them. He wasn't armed. All the black teenager did was appear threatening by shooting Miami-Dade police officers a few "dehumanizing stares," and that was apparently enough for the officers to decide to slam him against the ground and put him in a chokehold.

During Memorial Day weekend, McMillian was rough-housing with another teenager on the sand. Police approached the teen on an ATV and told him that wasn't acceptable behavior. They asked him where his parents were, but MicMillian attempted to walk away. The officer jumped off the ATV, and tried to physically restrain the teen. According to CBS Miami, police say the 14-year-old kid gave them "'dehumanizing stares,' clenched his fists and appeared threatening."

McMillian says he was carrying a six-week old puppy at the time and couldn't have been clenching his fists because he was feeding the dog with a bottle. He claims that during the confrontation the dog's front left paw was injured while officer forcibly separated him from the dog.

The officer then forced McMillian to the ground and put him in a choke hold.

Once again, the police interjected themselves where they were not needed or wanted. They created this whole situation and try to blame it on the kid. This is happening much too often, everywhere. The police have forgotten their place and need to be reminded, post haste. Used to be a time when cops were peace officers, now they are just pieces of shit.

People need to watch the you tube video "Don't talk to police".  It is chiling.  I'll never talk to the police, even for a traffic violation.  I will take the 5th amendment.  Police have too much power and don't know how to use it!  I don't respect them at all anymore!  They are liars!  They don't want the truth.  They will lie to get what they want.   No one should trust them at all!  I am a math teacher, not a criminal and have never been arrested, but the things I now know about cops disgust me.  I would prefer to defend myself, screw cops.

curious what would happen..if someone called or showed up at a miami police station..and wanted to turn themselves in saying" yes ive clenched my fists before and given the police dehumanizing stares, they just never arrested me for it, now that i know its a crime..im turning myself in"...and what if a few thousand people did this on the same day..

Actually buddy it's not the police but society as a whole. Young people and adults have no respect for anything anymore and media only shows stories that incite people instead of showing the whole truth. Yes there are bad apple, but majority I have ever served with are nothing but honorable. It's a good thing you never followed in their footsteps. Sounds like you couldn't handle the pressure.

This culture of bullies with badges country wide has got to change! This is a crisis! Cops keep abusing their power and kids keep growing up not trusting and hating cops. I truly dislike cops in my core being b/c of events like this and my own personal experience with cops. Anytime I have to talk to one my whole body becomes stiff, my voice restricts, I become short and just want to get the eff away from them. And I'm a law abiding 32 yo white woman living in suburbia. So I can only imagine how a young black man must feel knowing what he knows and seeing what he sees. Heaven forbid a black man demonstrate any feeling of anger or give a dirty look - we all know how dangerous "they" are.

secondly, since when can you put your hands on a minor for any reason....not acceptable in any case....the fact that these cops are trying to justify their actions and weasal their way out of trouble tells you instantly that they are corrupt...and how their superiors treat this case now will tell you if they are corrupt or not....if this is acceptable police behavior then the parents have the right to detain, beat, and shoot those cops without any repercussions as well...this is sickening...the people we pay to defend us treat us however they want and maybe they'll be suspended without pay maybe they will be fired either way these kind of actions out of Dade County police is the reputation they already had before this happened and now reaffirms everything I've already heard and I live in North Carolina...if it was up to me the punishment for assualt on a minor would be either 10 to 20 years in the federal prison or shot by firing squad in between their eyeballs and I'm white and have no ties to this situation...simple laws would stop this bullshit in its tracks with the technology we have in this 21st century....no need to squabble over who's right or wrong, put them in prison for 10 to 20 years and take away any property and money they have earned as law enforcement (same thing they do to pot dealers) and I bet this bullshit stops...so easy to fix yet it won't happen and i am ultra positive but i've seen this shit go on tooooooo long..fuck you cops

you cant just abuse the power given to you with that badge....this is why people get nervous and don't cooperate with cops because they go over the line 9 out of 10 times....if they would've done their job correctly, and told the boy to stop or he would be arrested I guarantee the boy would've stopped...either way all of their actions in this case were unnecessary....we are talking about a 14 year old with a puppy in his hands and several cops restraining, choking, and abusing their power obviously...no need to lie and twist the story he is 14 fucking years old unarmed with a puppy hands and has the right to look at them however he wants...fire any cop involved if you want the public to trust you at all dade county police.

The officer stops the boy and asks the question where are boy's parents. At this point the officer is conducting an investigation.

The boy has the right (and definitely should) not to cooperate and remain silent. But still he is at this point a suspect being detained by the officer. The officer can apply necessary force to keep the suspect in place for the time of his investigation, which may include a frisk for weapons (Terry stop). If the suspect is trying to leave, the officer can stop him, can handcuff him, and in the course of that can apply necessary force. That's why people in this situation usually say "are you detaining me officer, or am I free to go" (and nothing else). But they don't just turn away and leave, this won't work.

If in that process the suspect is physically resisting, this is not a crime (only resisting arrest is, while this is still not an arrest), but it will be overcome by officer's force. If the suspect is actively fighting back, this most likely will be an assault.

Accordingly, in this case, the fact that officer restrained the boy was probably justified,  if the officer wanted to prevent boy's leaving; however, the statements about the "threat" and subsequent arrest and charge are not.

I can't know if the event had anything to do with racism as it is seen by some. I'm 100% confident that it had everything to do with perceived wealth, power, and influence. These men did what they did because they felt safe doing it. If had been their bosses kid they'd never have done it yet this kid is the son of citizen and thus their bosses kid. The boss needs to push back.

Just let me say this: usually I am very professional and reserved in my comments. But I'm going to keep it REAL. This is BULLSHIT! It was BULLSHIT when I was growing up and it’s BULLSHIT now. This TYPICAL behavior demonstrated by the gang with badges (COPS), is the same reactionary behavior patterns the youth (especially minorities) in (REDNECK VILL) Oklahoma were constantly subjected to. It was a part of life growing up. Imagine my amazement in later life after joining the service and learning not everyone get brutalized, bullied, harassed, stopped and searched, constantly for walking down the street after dark, driving a car with rims, hanging out in a group of more than three people or now giving a street gang member with a badge (COP) a dirty look. It’s an absolute travesty that some of us are forced and conditioned to a way of living that most people would call a nightmare. It’s kept alive even today by the very people that swear an oath to “PRESERVE THE DIGNITY AND RESPECT THE RIGHTS OF ALL INDIVIDUALS.”

Look at the size of this kid and the size of the cop! The child has no shirt on so there is no weapon! What gives the police to manhandle a person? Unless they are searching or putting on handcuffs they have no right to put their hands on you! I am so sick of this madness and it needs to stop now!

It bothers me that the natural reaction of trying to pull away from someone grabbing you is constituted as an automatic threat by police. It is such a natural thing to do. Especially when you you are only 14 and know you weren't doing anything to require police intervention. It is like they assume all black kids get in trouble enough that they'd already know police procedure at that young age.

And for the family, please set up a petition on change.org to have all charges dropped, then start the legal process to charge the arresting officers with harassment, false arrest, and assault. This worked with my sister who was arrested for "resisting arrest" when she was video taping the brutality on another sister. Please stand up for our youth's rights and future depiction of them.

There is one good thing that came out of this.  Because the judge is sending it to a trial.  You do realize that the Jury of Piers can overturn any bad law that is charged to this person.  Then it would become precedent and future crimes against us the AMERICANS would not take place.  By overturning bad laws with Jury trials we can take back our freedom.

@vralias-fb Being questioned and being detained are not the same thing. If he is not under reasonable suspicion of having committed a crime (and horseplay on the beach with a friend, especially when you are 14 years old is not a crime), he cannot be detained. Period. The police can ask him anything they want, but he is under no legal obligation to answer, nor is he barred from simply walking away, as he attempted to do. This is open and shut.

@baberuth71 This is a criminal case, there is no jury of peers, it's usually a bunch of people who have nothing in common with the person on trial and they're only "peers" because they belong to the same species. Secondly, precedents are set in supreme court cases usually.

My grandfather was the first Chief of Police in my hometown, grandmother a court clerk, mother a dispatcher and several uncles and cousins were/are officers, as well. I still won't call the cops for any reason. Today they are power hungry, undisciplined thugs that behave as though above the laws they are sworn to uphold and better than the citizens they seek to criminalize. I've seen first hand the age of integrity within law enforcement pass. There is so little honor left I no longer refer to them as law enforcement, but simply police departments. And the legal system that protects these henchmen is a farce driven by revenue generation and apartheid. I'm guessing you're one of the bullies in blue yourself that dishonor the memory of my grandfather, the last honorable cop I've known.

As an honorably discharged disabled former Marine, I'll tell you that standards for military service are higher than they are for police departments. A man actually sued and lost because he was rejected for police academy for scoring too high on the exam. Court upheld the rejection stating that intelligent people will become too bored with the work. Most of us know that the real reason intelligent people are rejected is their tendency to question unethical and unintelligent orders.
