Marco Rubio Introduces Constitutional Amendment Aimed at Ending "Obamacare"

In a bid to stir up some PR and reaffirm his party's opposition to Obamacare, Florida Senator Marco Rubio proposed a constitutional amendment today that would effectively eliminate the personal mandate section of the Patient Protection and Affordable Care Act.

The thing has about zero chance of actually going anywhere, though.

Rubio has dubbed the proposal the "Right to Refuse" amendment. It would make it illegal for congress to tax citizens who fail to purchase a a good or service. Which would effectively null the individual-mandate.

The Supreme Court ruled last year that the individual-mandate was perfectly constitutional (though the law still faces other suits that could come before the Supreme Court aimed at the employee mandate and the contraceptive mandate).

"We should put our faith in the American people to decide what goods and services they want to buy, not have Congress dictate it and have the IRS empowered to harass Americans to make sure they do it," Rubio said in a press release.

Of course, this is all just political posturing. And considering that Rubio has been criticized lately for his stance on immigration by some conservatives, and he could use a boost in his right-wing credentials if he really does seek to make a presidential run in 2016.

To even propose an amendment, congress would need to pass it by a super-majority of two-thirds in both the House and Senate. That's not going to happen with this proposal anytime soon given the makeup of the congress. And even then it would then need to be ratified by three-fourths of the states.

Though, companion legislation has been introduced in the House by a Mississippi Republican.

just another dopey waste of PUBLIC resources that secures FLORIDA as the laughingstock of AMerican politics

i guess with BACHMANN quiting the GOP has to have a replacement and RUBIO certainly has the limited mental capacity to be just the right person at the right time

he probably has NEVER actually read the US CONSTITUTION and thinks changing it is his right

it reminds me of GEORGE WALLACE who also would have made owning SLAVEs constitutionaly even after the 13th amendement and civil-rights were already legislated

little marco has very few supporters and was voted in without much vetting by a constituency that hasn't ever had competent representation

RUBIO is no scholar or has any gravitas in government and is just a guy who speaks spanish and takes a good photograph..............BUT once he opens his mouth he immediately reveals his AIRheadedNESS

just ask him what the difference is between OBAMAcare and massachusetts' COMMONWEALTHcare

(answer: they BOTH had the same architect Jonathan Gruber and MITT ROMNEY was governor of massachusetts when COMMONwealthCARE was passed = TIM PAWLENTY called the two plans OBOMNEYcare with NO real differences)

Rubio's 2010 senate campaign was fined $8,000 by the Federal Elections Committee for receiving "prohibited, excessive and other impermissible contributions totaling $210,173.09."




Records show Rubio sent payments to American Express totaling $13,900 for his personal expenses during his tenure as House speaker. But those payments were not made monthly. He made no contributions to the bill during a six-month stretch in 2007, records show.


One committee paid relatives nearly $14,000 for what was incorrectly described to the IRS as "courier fees" and listed a nonexistent address for one of them. Another committee paid $5,700 to his wife, who was listed as the treasurer, much of it for "gas and meals."


Rubio's wife, former Miami Dolphins cheerleader Jeanette Dousdebes, served as the committee's treasurer. In reports filed with the state, Rubio and his wife failed to disclose more than $34,000 in expenses over an 18-month period.

Indeed, the far-right senator was about using a Republican Party credit card to purchase personal items. Rubio conceded it "looks bad," and acknowledged, "I shouldn't have done it that way."

It's worth noting that we're not talking about minor purchases -- Rubio billed the state GOP for more than $100,000 during his two-year tenure as Florida's House speaker, including repairs to his family minivan.

Their pay should be whatever the median wage is in America for the previous year. If median wage goes down they take a pay cut, if median wage goes up, they get a raise. That way we know they will be working for us.

We could solve a LOT of problems in this country if we just required that politicians live by the same rules as the rest of us.

Put THEM in 401-K's and Social Security for their retirement; put THEM in Medicare; have THEM follow the same "truth in advertising" laws businesses have to follow, let THEM pay for their own vacations instead of the taxpayers sending them on junkets; have THEM obey the law on discriminatory employment practices,Make Politicians Take a Pay Cut Before Cutting Money from Education and Social Services!

Hey they should cut their own benefits and services.”

@drakemallard @miami-sidBachman was just a house member from a gerrymandered district of undereducated rednecks. Rubio is a senator of an enormous state with massive poverty issues. Big difference. Only in the Southern USA do people that stupid get this far.
