Tremaine McMillian, Teen in "Dehumanizing Stares" Incident, Will Have All Charges Dropped

Tremaine McMillian, the 14-year-old boy who was forced to the ground and head-locked by Miami-Dade Police because, among other things, they claimed he was giving them "dehumanizing stares," had his day in court this morning.

McMillian was also facing two unrelated charges, but all charges will be dropped on the condition that he successfully complete a juvenile diversion program.

McMillian also faced three other charges: strong-arm robbery for pushing a child off his bike and taking it, burglary of a structure for entering a fenced-in yard and taking a puppy, and resisting arrest without violence for the incident at Haulover Park in May. (There's no confirmation that the puppy he was carrying during the Haulover charges is the one he's alleged to have taken.)

McMillian entered a plea deal today. For the next two years, he'll be on probation and must complete the Empowered Youth Program. He must attend meetings two to three times a week at the Tacolcy Center in Liberty City; officials claim the program has a history of success in steering boys away from further involvement in the criminal justice system.

If McMillian successfully completes the program, sticks to the terms of his probation, and avoids any other charges during the next two years, all charges will be officially dropped and removed from his record.

While a diversion program is good, the charges really should have been Non-filed by the SAO. There will still be a record of arrest.

@frankd4 You obviously don't recognize that being Italian is less identifiable when running for office than being black. People don't immediately say he's Italian when describing one of you but they certainly say "he's black," when describing us. Government posts require elections, elections that are often rigged against African American favors...Gerrymandering anyone? Furthermore education costs money, my Ivy League degree wasn't cheap and it was extraordinarily difficult to obtain. African Americans are trying to "get educated" but most of us end up in prison for a minor offense or dead by a scared cop long before the matriculation bells ring. The rest of us struggle to obtain loans without government aid, aid that's being cut and attacked as wasteful by a certain political party with a crusade against poor people, gays, and women. All this while school budgets are slashed from their already dismal local tax revenues and white flight continues to drive these schools into bankruptcy (maybe schools should be funded per student rather than by their local revenues. Rich schools often have 5-10 times more to spend per student than schools in poor areas). Oversimplification of the issues facing the black community will do more to harm it than to help it. The "grab yourself by the bootstraps" method you advance to the black community assumes this country is a meritocracy and that economics and racism plays no role. Why don't you educate yourself and support the things that will actually help the black community, more Pell grants and better funded schools in poor communities is a decent start.

@Phil Ramirez I doubt those allegations are true. Do you really believe the state would drop "real" theft charges if they had a case. They're simply not that nice to black people, especially not near Miami-Dade home to the nations sixth largest prison.

@Alice Gomez I agree that the charge is absurd. But how do you know what race the cop was? If you want to bring racism into it make sure you know all the details. On another note it is harder to become a cop if you are white compared to all other races. Thats a fact if you are in a dominate city.

HERE is the secret to FAMILY.......IF we ever would have gotten into the trouble this BLACK kid is in...........beaten up and arrested..........WE WOULD HAVE gotten beaten up AGAIN when we got home for the SHAME and HEART-ACHE we lighten on our families who worked too hard for too long to be raising criminals and back-sliding

@pinkbetty11 That's true but they don't usually kill you for taking out your wallet too fast or arrest you for staring. They let you go with a warning. Furthermore by percentage, African Americans are far more likely to be poor and therefore far more likely to be harassed. But even when we're not poor we're still harassed (Harvard professor arrested in his home anyone). A certain black kid living in a gated community in a Florida city recently learned that lesson the hard way when he was gunned down not by a police officer but by a civilian.

THE PROBLEM IS - being born withOUT a nuturing and available married mother AND FATHER who are educated enough to be employed to afford children in THEIR own home without relying on any government hand-outs for food or shelter or other provisions

the BLACK problem ALL stem from a disintigration of family a self-sufficient educated and employed family meaning MOTHER AND FATHER both involved in raising and nurturing and providing for THEIR CHILDREN without government assistance
