Carlos Bertonatti Gets 12 Years in Jail for Fatal Key Biscayne Hit-and-Run

Carlos Bertonatti today was handed a 12-year sentence for the DUI manslaughter of Christophe Le Canne in 2010, finally bringing justice for the cyclist more than three and a half years later.

On an early morning in January 2010, Bertonatti, an aspiring pop star, was driving his Volkswagen back to his Key Biscayne residence after a long night of partying at Space. Bertonatti's VW hit Le Canne, a married father who was cycling along the Rickenbacker Causeway, but didn't stop. Le Canne's bicycle became lodged underneath the Volkswagen and was dragged for more than three miles.

Bertonatti was speeding and swerving at the time. His blood-alcohol level would later come back well over the legal limit, at .122.

The court case was delayed several times before Bertonatti pleaded guilty to DUI manslaughter and resisting arrest without violence.

Bertonatti had a long list of blemishes on his driving record before the accident; his license was suspended in 2009. However, Bertonatti's brother Miguel told prosecutors that he had used Carlos' identity several times over the years to avoid getting several tickets on his own record.

Despite the last-minute twist, Judge Bronwyn Miller sentence Bertonatti to 12 years in jail. He faced a maximum of 25 years.

Vanessa Castillo is making idiotic comments. She says that no one here is in position to play judge, jury, and executioner. So, according to her, we should just let others make all decisions for us and never take responsibility for improving society, because we do not have all of the facts. Therein lies the problem with this country. People like Vanessa Castillo who want to keep us down and prohibit us from - not only stating our opinion - but if we only have a speculation of someone breaking the law, we should be prohibited from doing anything about it, and not be allowed to investigate further. By the way, Vanessa Castillo, it is theoretically impossible to know 100% of the facts. You contradict yourself in so many ways, you are only speculating with your *facts* & perception that the sentence is unjust compared to *rapists & murderers*. You are allowed to defend your friend on tis board, but I would judge that you ought to take more intellectual responsibility for your thought actions.

It's a shame, because he's a good person. He made a reckless mistake that unfortunately cost someone his life. He's not getting away with anything, he's doing his time. If the law requires 12 years, then so be it. No one here is in the position to play judge, jury and executioner. People make mistakea, some bigger than others but regardless we shouldn't pass judgment without knowing everything. He's shown remorse and he will serve his time, so justice has been served. There are rapist and murders who don't even get 12 years, now that's unjust. I'm not ashamed to admit that I know the real Carlos Bertonatti, not the monster that the media painted and despite his mistake he is a good person.

12 years is gift and if I'm not mistaken they must do 85% of that time meaning he could possibly do less than ten years. Pretty sad.

Wow... I actually met Carlos a couple of times before this accident. He was a sweet kid, really family-oriented and well mannered. I completely agree that actions must have consequences and that he should do time for his stupid, irresponsible decision of driving drunk which cost someone their life. Absolutely. But these comments about how he should do life and 12 years is too little? I think it´s too much. Rapists have gotten less time, people who killed someone on purpose have gotten away with it. Give the guy a break.

@Vanessa Castillo Stop telling people not to pass judgement just because the convicted person was or is still a friend of yours.I will bet anything that if the victim was your son or your brother,you would be singing a very different song right now.The sentence is not about punishment or revenge; It is about sending a strong message that as a society , we are sick and tired of motherfuckers who get behind the wheels of a car while drunk .I ,myself got hit once off my bike by a drunk driver and luckily for me,just broke my ankle.I lost two good friends in New York who got killed by a drunk driver while they were riding together.The problem with these so called accidents is that we never know if they were accidents or pure acts of murder......I say he should have gotten more time.

Hi Bodagpc - Look up the driving record of Carlos - more than 40 infractions!  LOSER!  Also, a history of arrests since he was 18 - maybe more that aren't noted from when he was a minor!  He got DOZENS of "breaks" before he killed a husband and father!  Twelve years is a gift for him!  His victim's baby won't even be out of high school before the LOSER is back on the street!

@Ceeing Redd Child molesters, rapists and murderers who have purposely killed someone don´t get life a lot of times... and they get off even sooner on parole. But someone who didn´t mean to take a life and has to live with the horrible consequences of his stupid decision should get life? He didn´t mean to kill the guy. That doesn´t make him innocent, but I think you´re taking it too far.

@Susie Hair Hero had he been a regular guy who came from the hood, that's where he'd be driving....not on fancy a$$ key biscayne. its also more than enough time. if the purpose of jail is to rehab a criminal, then this will work. we can rest assured that when he gets out he will not do it again. unless of course you'd prefer to pay for his lifetime incarceration with your tax dollars or inject him with lethal poison. the punishment fits the crime. look around you.

@bodagpc How in the world can you claim that he didn't mean to do it ?Were you ther in the car next to him when it happened.? I personally got behind the wheel of a car once after having a few drinks.After stopping at a large intersection,I took my foot off the brakes and proceeded to drive when only the cars making a left turn were supposed to go.Luckily for me and other people out that night,nothing happened and the police was not present.I said my thank you to the traffic god and has not touched any alcohol before driving since then.Now,it is more necessary because I have stopped driving cars and has taken up riding a motorcycle......A person can not continue to take chances with other people's lives and when someone dies , he or she claims that it was an accident.Accidents are things that could not have been avoided.This death could have been avoided if the convict had behaved responsibly
