Florida's Texting-While-Driving Ban Starts Today, Will Probably Stop No One From Texting While Driving

If you're texting a link to this story on your iPhone while you sip coffee and weave through morning traffic on the Dolphin Expressway using your knees -- JUST STOP IT. Years of appealing to your common sense clearly hasn't helped, so perhaps you'll respond to the news that beginning today, texting while driving could cost you some cash?

Then again, probably not. For all the hooplah, Florida's new ban on texting on the road is some seriously weak medicine. Cops aren't allowed to pull drivers over for phone abuse, and if they're somehow caught anyway, the top fine is just $60.

It took Florida lawmakers five years to become the 41st state to recognize that people should not stare at tiny keyboards while hurtling down roads at 75 mph.

Yet the ban Tallahassee finally passed last session is hilariously soft. Instead of making texting while driving a primary offense, giving cops license to pull over drivers they spot wrangling with autocorrect on the freeway, they made the crime a secondary offense.

That means if police pull you over for speeding or running a stop sign and you're dumb enough to continue texting while they pull you over, they can tack on an additional charge.

Of course, that charge will net you just $30 on a first offense and $60 a pop afterward.

At least one legislator is already planning to toughen the law in Tallahassee this year. Sen. Maria Sachs, a Democrat from Delray Beach, will announce this afternoon her plans to push for stiffer penalties for texters on the road.

In the meantime, feel free to text at red lights and stop signs -- that's still permissible under Florida's new law.

Any of you have read the language in the law?! It allows texting if "caught in a traffic jam" so basically, it's unenforceable. What they should do is this: first fine? $200 and 5 points in your license. Next fine, if any after those points?! $500 and suspension for 1 year, just like they do in civilized societies like NYC and/or Boston. Of course, I expect some Hialeans claiming their famous "...(eh!) yu don likey he'a, you can go somewheh eals (eh!!). Go back'e to nueva york, this is how we du in the 305."

look at all the retarded native fl drivers complaining about this being law... ive lived in a couple of the states that banned it and the texting issue isnt nearly as big of an issue up there as it is here, it is ridiculous how many people in miami are doing other shit other than driving while on their stupid little shitty phones... get over it, i hope the fine is like four thousand bucks and a night in prison.. so the retards that cant detach the umbilical cord of their boring ass social life somewhat learn.... usually it takes these retards killing or hurting someone for them to realize how not worth it it is to text while driving...... so kudos to fl late or not.

So for the past 4 years texting caused more accidents than drunk driving in the US.  6 times more accidents.  Perhaps if you got your license suspended, car impounded, and a $3500 fine for a first offense like in a DUI then maybe we will start to see some change.

And how exactly will they be able to tell I wasn't just changing a song on my iPhone? How will they prove in court that I was sending or reading a text unless they're driving right next to or behind me in a bigger vehicle that can see down into mine?

@Adrian Rivera can't they subpoena phone records...? if at 8:47 you were pulled over a couple of miles from your home and your records show a series of texts being sent at 8:45, then it's pretty obvious you were texting while driving...

@ivxx A valid point, but they can't prove I didn't stop or pull over before I sent that text. They would literally have to see the texting app open and me texting to prove it, which to me seems they can only do while tailing you.
