"Revenge Porn" Bill Unanimously Passes Florida Senate

They don't agree about much up in Tallahassee, but apparently every state senator is against "revenge porn." A bill that would make it illegal to post explicit photos of another person online without his or her permission passed the state senate unanimously today.

SB 532 would make it a second-degree misdemeanor to disclose a "sexually explicit image of an identifiable person with the intent to harass such person if the individual knows or should have known such person did not consent to the disclosure." Which basically means if your girlfriend breaks up with you, it will be illegal to post her nudie pics on Reddit or other posting sites for revenge.

If the suspect is over 18 and the victim is under 16, the crime would be bumped up to a third-degree misdemeanor. Of course, child porn charges could still be applicable in some cases.

The bill gained steam after an incident at the University of Central Florida in which 20-year-old Sean Shahid was upset with his ex-girlfriend for talking to police about a burglary in which he might have been involved. So to get revenge, he posted explicit photos of her on Instagram and Twitter.

He was jailed on charges of stalking and tampering with a witness because no Florida law specifically outlawed the posting of the pictures.

However, before the bill becomes law, it must pass the state house. That version of the bill has not yet been heard in any house committee. The house has until May 2 to pass the bill.

how important is the intent to harass part of this law? i mean, how is harass defined legally, also; is it considered to be some intent to harm? what about negligence? or better yet, willful negligence?? or what if the person asks, you say no, but they post it anyway and you find out third-hand only years later???


is there a statute of limitations that applies here as well, i mean, seriously, i just found out about a video that was posted of me on xtube, and i am kinda pissed, not that i care or feel "harassed", but i feel sort of violated in the sense that someone has used me to advance their own agenda, i guess you could say, or cause, or their own image... basically, in some way, they have profited from using my likeness in a video, which was recorded without my knowledge...


... they had even asked me if they could record video using a camera, and i had explicitly said, "no, i'd rather not," and even if i had not, i still am DAMN sure that i did not consent in any way, shape or form consent for it to be distributed in any manner....


can this be considered a copyright violation case, with me as the plaintiff, is something that i am very curious to know... i am less concerned with punishing him through the criminal system, i mean, what does that get me, anyhow?? i would much rather see that they need to owe some kind of civil damages to me, personally, you know?... i mean, cuz i ain't a prude, i don't give a fuck who sees me totally naked and fucking... but damn, if you asked, i said no, and you did it anyway... i mean, i'm just pissed and want the guy to pay, literally... something tangible to me.... BLAH!!!...

The guy was arrested and charged with two crimes because their wasn't a specific law regarding posting on the web? INSANE. So, pass another law that is going to require training and enforcement challenges. Just how is "permission" supposed to be obtained? He said/she said? "But officer, she TOLD me I could..." or how about, "Honey, I'm learning to interpret handwriting. Would you sign this blank piece of paper and I'll tell you what it means?"

Cary's right. We know that technology has made this an incredibly small world where privacy is harder and harder to maintain every day. Given how many future partners, employers, and even your own children may see what you do in the future (nothing digital is ever truly erased), then we should all act accordingly. Stop being attention-whore, validation-seeking teenagers who feel that you have to project a certain desirable image of yourselves in order to be recognized. I've never needed a girl to send me HD close ups of her vag... but then again, I'm with people for who they are - *in REALITY* - not for the idea of who they would like me to think they are. Anastasia Biltmore If someone can abuse the system, should the instrument they're abusing be abolished? Someone can murder anyone, plant dna evidence of their enemy, place the weapon in their enemy's home/car, and think of all the intricacies in order to frame that person. It's an extreme example and posting a nude is a lot easier than framing someone for murder, but if abusing the system is an argument for just not having something, then welfare wouldn't exist... or any law for that matter. It isn't as simple as posting a nude and filing a claim; there's elements that need to be satisfied. The same way a person isn't negligent because you said they were negligent, because the elements of duty, breach, causation, and damages have to be satisfied in order to bring a successful claim.

My examples probably sent the same pictures to multiple people. So you'd have to prove that I was the one spreading them.

Since when is having sex with somebody you trust, assuming they're your partner, a "compromising situation"? The social stigma experienced when a video of a couple having sex is posted online as revenge shouldn't be on the woman, it should be on the man for being a piece of shit for attempting to humiliate someone who trusted them enough to make the video in the first place. What a trip. I love these responses. Personally speaking, I think any man or woman that does something hurtful to a would be ex is a dush and loser. If someone breaks up with you.
