DUI Checkpoint Tonight on Rickenbacker Causeway

Four years ago, Christophe Le Canne, a South Miami family man, was riding his blue Cannondale in the bike lane on the Rickenbacker Causeway when he was struck by a Silver Volkswagen and killed as the driver, Carlos Bertonatti, drove away dragging his bike. But without better safety measures in place, the deaths on the Rickenbacker have continued, to the outrage of local cycling groups. "As many of you know, we have been advocating for safer cycling condition[s] on the Rickenbacker Causeway for the better part of half a decade and the County has done virtually nothing to make it safer," Felipe Azenha wrote in January on transitmiami.com.

Cyclists will have to keep waiting for dedicated bike lanes and lower speed limits, but police tonight are at least discouraging future Bertonattis from taking the road. A DUI checkpoint will be held on the causeway, from 7 p.m. to 1 a.m., just before the William Powell Bridge.

"Numerous requests from the public have been made requesting the police agencies to take enforcement on the causeway before more serious injuries and deaths occur," Miami police wrote in a press release.

No Zach Brookes you are misinformed. In 1990, SCOTUS decided on this question ( it was a narrow vote if that helps) DUI checkpoints do NOT violate the 4th Amendment, but the Court ruled that states could exercise their own discretion. Only 11 states forbid DUI checkpoints. In general ( without a long dissertation in legalese as to why this makes perfect sense), I will simply tell you that 'public welfare" generally overrules individual rights in most matters. Clearly, WE THE PEOPLE have a 'public welfare" interest in keeping a drunk off the road and the further obligation to take such measures as we deem necessary to do so.

Another illegal check point remeber folks 1)you can now legally film them. Proven by the supreme court ruling this week. 2) dont consent to a search they need a warrant without probable cause for the search 3) if you are not being detained you ask if you are free to leave. Know your rights..

Just an FYI. They'll probably arrest only a couple people and give seat belt tickets for everyone else. Meanwhile, somewhere else in Miami, someone will die from a drunk driver.

Exacly, 7 pm-1 am is USELESS. The really crazies are on the road from 1 am-7 am. Come on police, do the 1-7 am shift!

In most states it is unconstitutional. That's why they have announce it. And cops actually hate to do them. Or I should say seasoned cops. Waste of time to arrest one person in 4 hours for DUI. If they cared, they would do it at 3am to 6am when the real drunks are out.

Damian, a DUI checkpoint does not violate your Constitutional rights. You as a citizen are not being targeted personally. Keep in mind that driving is NOT a right for citizens. It is a privilege granted by each state under its own statutes and that state has the ability to review that issuance at its own discretion.

I hate that they have to give "warning" for DUI check points. Just do them!! These stupid drunks shouldn't have a warning of what area to avoid while driving drunk.

cyclists need to stfu and get out of the road. You want to ride on the same road as motorized vehiccles then don't complain when you get hit. Nobody is out there hitting cyclists on purpose. Ride on a road with a bike lane or stfu
