After DJ Laz's Fatal Accident, Key Biscayne Moves to Ban Motorboats from Mashta Flats

After two deaths and a rash of serious injuries just in the past year -- including DJ Laz's headline-grabbing incident when a man was chopped to death by the DJ's boat propeller -- the Key Biscayne Village Council has moved to ban motorboats from the offshore sandbar known as the Mashta Flats.

"It just gets worse and worse," council member Jim Taintor told Riptide. "And now it is completely out of control."

On Tuesday the council's motion to ban motorboats from the 12 acres of the flats controlled by Key Biscayne passed a second reading, and on Wednesday council members and police chief Charles Press pleaded with Florida Fish and Wildlife Conservation Commission (FWC) officials in Naples for additional help.

The Mashta Flats, long a popular destination for families, has in recent years also emerged as one of South Florida's top spots for offshore boat partying. Last September a Plantation man was killed in a diving accident at the site, and at a Memorial Day party 23-year-old Ernesto Hernandez was killed by the running propeller of a boat operated by Lazaro Mendez, better known as radio personality DJ Laz. Mendez's boat had gotten stuck in the sand; Hernandez was trying to help push the boat and was killed when Mendez flipped on the propeller.

"That's crazy, with the engines going," said Carlos Silva, a lawyer representing the Hernandez family. "He sucked my client under with the engines and killed him."

The 12 acres controlled by Key Biscayne represent only roughly 20 percent of the Mashta Flats area, with the remainder falling under state jurisdiction. Even after passing the resolution, the village still needs state approval before boats can be banned from the 12 acres.

Key Biscayne is also rallying FWC officials for a solution that would encompass the entire Mashta Flats area, which officials say under current circumstances is impossible to effectively patrol.

"It's really become like the Wild Wild West," Taintor said. "As we see it we have no other choice but to try to exclude motorboats from the flat."

We should also ban cars on the roads. People have been killed with them. We should also ban food, because people have choked to death on food. We should also ban animals because animals have killed people. We should also ban water because people have drowned in water. We should also ban government because 262,000,000 people were murdered by government in the 20th century.

With the IDIOTS we have elected to all levels of government starting with HOA NAZI's, they will ban every activity conceivable. Why don't we put everyone in prison where we will be safe.

As a parent that has endured the death of a child in a boating accident just 7 years ago, I don't believe in banning sites. I own jetskis and I am not a crazy driver.

This is not the answer nor will it stop accidents from happening.

The police, major and legislator has to enforce stronger boating laws!!!!! Stronger fines and hold boaters accountable for their actions!

DJ Laz killed Ernesto! Kenneth Herzbrun killed my son, Domingo Villata was killed by another boater and they are all out there enjoying life instead of being put behind bars.

There should be mandatory blood alcohol test. Yet boaters are not being tested. If you get BUI 90% just hugest a ticket and move along. There is no data base to see that they are drunk over and over again. Little to no jail time.

Mandatory boating Classes, boating license should be approved in Florida. My son was 23 and since his death I have talk to politicians and have met with the media and let me tell you it's all about the dollar. They give excuses it's the boating industry that we fight against. Guys, you're not suppose to be getting paybacks so just vote to pass laws!!!

A great example of this country's inability to learn and follow rules and instead of taking steps to better educate it's citizens we just ban things like it's gonna get people to stop. Why can't people just learn to be more careful?

The boat safety classes are free. We took out 2 years ago, and they had free coffee and doughnuts. Next time out we noticed more than 50 percent of opertors doing something wrong, or very stupid. Free classes people. The old coast guard dudes will even come to your house for a safety inspection. Did i mention FREE!

So 2 deaths by reckless people out of hundreds/thousands that pass by and have fun for countless hours having a good time will do it for the rest. There is something called "responsibility" and there are laws to deal with irresponsibility, enforce them and let people live their lives, go to Hawaii and there is not a single island beach side closed to the public, pretty much for the rest of the US. Miami, specially Key Biscayne's Wealthy want the peons out of their backyard and this all the excuse they need to keep them out. Not in the interest of saving lives but keeping people out of their million dollars homes view. Soon we will have to swim in a canal.
