According to Miami-Dade records, charges were filed against Eismann on June 26, 2013. The chef is being charged with vehicular homicide and a lesser charge of leaving the scene of an accident with property damage. Bond was set at $16,000 and an arraignment hearing is scheduled for July 5.

On October 10, Eismann was driving a Ford Explorer and was involved in a crash with a Nissan Sentra. While driving from the scene of the car accident, Eismann lost control of his vehicle and hit pedestrian Jean Carlos Ruiz two blocks away, around NW Third Street and 72nd Avenue. Ruiz was pronounced dead on the scene by authorities. The owner of the Nissan was unharmed. At the time, police said that charges against Eismann were pending.

Eismann was once arguably one of the most successful chefs in Miami, with multiple restaurants like Spartico, Pizza Volante, Fin, Q, and Pacific Time in his charge.
